A federal appeals court has stomped on an Obama-appointed radical judge who, in July, usurped the power of Congress by effectively vetoing a newly passed law preventing the use of Medicaid funding for abortion providers, including Planned Parenthood.
In a 3-0 ruling on Thursday, the 1st U.S. Circuit Court of Appeals in Boston, Mass., overruled US District Judge Indira Talwani by putting a hold on her preliminary nationwide injunction, clearing the way for the Trump administration to enforce the provision cutting off funding to some clinics, another win for President Donald J. Trump whose reform agenda has been obstructed by a battalion of Democrat lower court judges.

“Patients are likely to suffer adverse health consequences where care is disrupted or unavailable. In particular, restricting Members’ ability to provide healthcare services threatens an increase in unintended pregnancies and attendant complications because of reduced access to effective contraceptives, and an increase in undiagnosed and untreated STIs,” the activist judge wrote in her July 28 order.
In her intervention that temporarily blocked the provision in the “One Big Beautiful Bill” which Trump signed into law on July 4, Talwani resorted to the legal chicanery of claiming that the bill violated the Constitution’s “bill of attainder clause,” which prohibits Congress from passing laws that would punish persons or groups without a trial.
The Massachusetts-based Talwani’s putting herself above Congress was so brazen that it was even blasted by The Washington Post at the time.
“Allocating public money is Congress’ core competency. Yet US District Judge Indira Talwani not only countermanded Congress’ spending choice in a preliminary injunction, she also refused to stay her ruling pending appeal,” the paper’s editorial board wrote, adding, “This is the kind of lower court activism that gives the Trump administration fodder for its attacks on judges.”
“With this decision, patients and providers are in limbo. Patients who rely on the essential health care that Planned Parenthood health centers provide, can’t plan for their futures, decide where they go for care, or control their lives, bodies, and futures — all because the Trump administration and its backers want to attack Planned Parenthood and shut down health centers,” protested Planned Parenthood President and CEO Alexis McGill Johnson.
“This is a blow, but the fight isn’t over. For over 100 years, Planned Parenthood has faced unrelenting attacks, but we’re still here providing care, information, and resources. We will continue to fight this unconstitutional law, even though this court has allowed it to impact patients,” Johnson said in a statement.
“This ruling is a direct assault on patients’ lives. Nearly 40% of PPLM’s patients rely on Medicaid, and without it, many are left with no care and no options. While the Trump administration wants to rip away reproductive freedom, we’re here to say loud and clear: we will not back down,” vowed Planned Parenthood League of Massachusetts President and CEO Dominique Lee.
