After more than 32 months, the Justice Department made a move on the infamous Ray Epps that just so happened to follow the release of new Jan. 6 footage from an independent journalist.
Epps, a darling of corporate media whose victimization following the breach of the U.S. Capitol was perhaps rivaled only by New York Rep. Alexandria Ocasio-Cortez, (she almost died), was formally charged Tuesday with a solitary misdemeanor.
As submitted by U.S. Attorney Matthew M. Graves to the United States District Court for the District of Columbia, for “knowingly, and with intent to impede and disrupt the orderly conduct of Government business in official functions,” while the 2020 presidential election was being certified, Epps was charged with Disorderly or Disruptive Conduct in a Restricted Building or Grounds.
The charge for Epps, whose synonymy with Jan. 6 was comparable to that of Jacob Chansley, better known as the QAnon Shaman, came one day after independent journalist Stephen Horn was convicted of multiple charges for his efforts to document the events at and inside the Capitol.
As Horn wrote on X, “I told the same truth to the jury that I posted along with my video on January 7th [2021]: ‘I did not enter the capitol building as part of the protest, or for cheap thrills, but to accurately document and record a significant event which was taking place.'”

With a sentencing date scheduled for January, Horn saw fit to publish “Never before released” footage of Epps outside the U.S. Capitol, which appeared to commentator Julie Kelly to be similar to that used by the prosecution to target another J6 defendant.

The damning nature perceived by some added to well-established points about Epps’ presence on Jan. 5 and 6 and statements that he was alleged to have made. Further compounding the appearance that the Justice Department was merely issuing a slap on the wrist where others had had the book thrown at them, Kelly noted that out of 1,100 J6 cases, less than 20 featured “a single count information” following a cursory review.
What’s more, the only case she could locate with an identical single charge to Epps had been handed down to Isaiah Giddings, a member of the Proud Boys.
“Recall at least 15 FBI informants were in the Proud Boys before and on Jan 6,” Kelly wrote as she shared screenshots of court filings related to Giddings.

Kelly also pointed out that Giddings’s sentencing has repeatedly been delayed, a point that seemed to share another similarity with the perceived delay in Epps receiving his lone charge that had been expected in May.
Why hasn’t Epps been charged yet??
