DHS slams sanctuary county for ignoring its detainer requests for 2 ‘cold-blooded killers’

The Department of Homeland Security (DHS) is hitting out hard at a California county for ignoring its detainer requests for alleged murderers.

The alleged murderers, illegal aliens Franquin Inestroza-Martinez and Gerzon Jose Chirinos-Munguia, allegedly killed Kembery Chirinos-Flores, a 24-year-old mother of a 5-year-old son, on Jan 7.

That evening, police officers in Santa Clara County, a sanctuary jurisdiction, found Chirinos-Flores “bleeding in her car with multiple gunshot wounds,” according to a DHS press release.

“She was pronounced dead at the scene and leaves behind a 5-year-old son,” the press release continued.

Two months later, on March 5, local law enforcement arrested Inestroza-Martinez and Chirinos-Munguia for Chirinos-Flores’ murder. An analysis of their records makes it clear that neither man should have been running free the night of the murder.

“On June 12, 2013, Inestroza-Martinez, a Honduran national, was caught illegally entering the United States by Customs and Border Protection (CBP) agents,” the press release notes.

“He was arrested and removed. On February 1, 2018, he was caught illegally re-entering the United States—a felony—and removed a second time. He illegally entered the United States a third time at an unknown date and time,” the press release continues.

Here’s the problem: He’s had an outstanding warrant for his arrest as per the murder of somebody else — reportedly a 55-year-old New Jersey man named Esteban Vicente Sacalxot, “who was found dead in his Trenton home from gunshot wounds on March 17, 2025.”

Then there’s Chirinos-Munguia, who reportedly shared a child with Chirinos-Flores.

“On May 18, 2015, Chirinos-Munguia, a Honduran national, was caught illegally entering the country by CBP agents and was later removed,” the  DHS press release notes. “At an unknown place and time, he illegally re-entered the United States—a felony—and has been illegally living in the country.”

Here’s the important part: In April of 2018, he was arrested for battery and false imprisonment. And on Sept. 20, 2019, he was arrested in the same county as Chirinos-Flores’ murder “for domestic battery and threatening crime with the intent of terrorizing.”

After his arrests in Santa Clara County, U.S. Immigration and Customs Enforcement issued an arrest detainer for him, demanding he not be released back onto the streets. Yet, surprise, surprise, county officials released him, and now Chirinos-Flores is dead.

“A man lost his life, and a child is now without a mother,” Acting Assistant DHS Secretary Lauren Bis said in a statement. “These illegal aliens should have never been able to commit these horrific killings and must NEVER be released from jail into American communities.”

“Instead of cooperating with ICE, Santa Clara sanctuary politicians REFUSED to honor ICE’s arrest detainer and will not notify ICE when these murderers are released from jail. This insanity of refusing to turn cold-blooded killers over to ICE must end,” she added.

According to Fox News, at the root of California’s problem is the California Value Act (CVA), a “sanctuary” law that limits cooperation between local police and federal immigration agents.

“The CVA was signed into law in 2017 in response to the immigration efforts of President Donald Trump during his first term,” Fox News notes. “The Trump administration sued California over the law throughout 2017-18, though the suit was dismissed by the U.S. District Court for the Eastern District of California. The suit failed again during appeal, and the Supreme Court declined to hear the case in 2020.”

The latest victim, Chirinos-Flores, is being remembered for being a hard worker.

“Kembery was in the prime of her life. She was working two jobs, and she was the loving mother of a 5-year-old son,” Santa Clara Department of Public Safety Chief Dan Pistor reportedly said at a press conference following the arrests of Inestroza-Martinez and Chirinos-Munguia.
