Dayne Victor Miller, 44, of Cape Coral Florida was taken into custody at the Lee County Jail when authorities were alerted by both the victims and the suspect to gunfire in the home. Later that day the Cape Coral Police Department released a statement detailing how an inebriated trip to the bathroom supposedly went awry.

According to law enforcement, Miller had been drinking with his tenants on the night in question before they were summoned to the house just after 12:30 a.m. The male renter was said to have gotten up in the middle of the night to relieve himself and on the way back to bed had entered the wrong room and fell asleep beside the homeowner’s teenage daughter.

“Mr. Miller called dispatch and said that one of his roommates was naked in his teenage daughter’s bedroom, which sparked him to shoot at both roommates through a closed bedroom door,” the police report read.

“The victim’s spouse woke up the victim and shouted that the room the victim was in was not their shared room,” it further explained. “Once they returned to their room, Mr. Miller approached their bedroom and began pounding on the door shouting, ‘I’ll kill you,’ after the door was shut and locked on him. That is when Mr. Miller shot his handgun 3-4 times into the floor outside the bedroom door in a rage.”

Neighbors of the Millers spoke with NBC2 and voiced their surprise at the incident, testifying not only to their demeanor but noting surprise as well to learn there were even tenants living in the home.

Monica Taylor said, “They’re nice people so we’ve never really had any problems. What happened with his daughter and everything…that’s kind of disturbing. I didn’t even know that they were renting a room out in that house.”

Meanwhile, neighbor Mike Bolding commiserated with how Miller must have felt while voicing concern over how the father had expressed his rage. “It gets kind of concerning when guns are involved. I would feel pretty outraged myself,” he told the outlet.

As for the suspect’s daughter, authorities noted that she had alerted her father to the presence of the naked tenant in her bed while the spouse was dealing with her husband, but that “she did not allege a crime had occurred against her.”

It was not readily apparent who was first to discover the naked man in the teenager’s bed.

Miller was charged with Aggravated Assault with a Deadly Weapon and Shooting into an Occupied Dwelling and, as of Friday afternoon, he remained in custody and had not entered a plea, according to Inside Edition. The suspect’s arraignment is scheduled for April 10.
