Former Virginia Attorney General Ken Cuccinelli believes Virginia’s new congressional map will be struck down by the state Supreme Court.
On Tuesday, Virginia residents voted in favor of a radical congressional map that strongly favors Democrats.
A day later, Tazewell County Circuit Court Judge Jack Hurley Jr. overturned the vote, calling the ballot language “flagrantly misleading” and complaining that Democrats hadn’t followed state constitutional rules when drawing the map.
Asked about this on CNN yet another day later, Cuccinelli predicted the map doesn’t stand a chance in hell of surviving very long.

“Well, it certainly was flagrantly misleading, but my basic reaction is that I appreciate lower court wins, but the Virginia Supreme Court is going to decide this,” he said.
And, he continued, the court will most likely vote against the map because of how state Democrats had gone about drawing it.
“What isn’t in keeping with Virginia legal history is how this General Assembly has so blatantly ignored the requirements of the Constitution to amend the Constitution,” Cuccinelli said. “So I think it’s highly likely that this will be overturned probably in May.”
Later in the interview, CNN host Jake Tapper asked him whether Republicans had spent enough money campaigning against the new redistricting map.
“It’s hard to say that money didn’t make that difference, but now they have to win four constitutional challenges, state constitutional to clarify, challenges, and they have to win all four of them to hold on to this referendum,” Cuccinelli replied.
Current Virginia Attorney General Jay Jones, a radical Democrat, has vowed to appeal the judge’s ruling in the map case.
“An activist judge should not have power of the People’s vote,” he said in a highly inflammatory statement shared to social media.

Virginians for Fair Elections, a blatantly partisan group, added in a statement that “voters understood exactly what was on the ballot, and they chose YES.”
“Republicans lost. Now they’re trying to overturn the will of the voters in court and trying to relitigate an election they couldn’t win,” the statement continued.
Meanwhile, redistricting efforts continue to unfold across the country, both in red states and blue states.
“Redistricting battles are unfolding across the United States in what analysts describe as an unusual mid-decade ‘arms race’ over congressional maps ahead of the 2026 elections,” according to Newsweek.
“Traditionally, districts are redrawn once every 10 years after the census, but recent efforts have broken that norm, with both parties seeking an advantage,” the reporting continues.
The battle was technically kicked off after President Donald Trump demanded Texas Republicans move forward with a new map that would favor Republicans.
However, the president’s defenders say the real culprit for the ongoing redistricting wars is New York.
“New York started it,” Republican Rep. Claudia Tenney alleged in a recent tweet. “After an extreme gerrymander by NY Dems in 2022, completely ignoring the Independent Commission they created in 2014, the Court of Appeals in NY restored fairness. Then, the Dems sued again in 2024 to overturn the Court of Appeals decision. They bullied 2 Court of Appeals judges off the bench and forced new Dem. favorable maps and the Reps lost 4 seats.”
“In 2026 they AGAiN sued to gerrymander and eliminate the Rep seat in Staten Island and were looking for even more power. The US Supreme Court stopped the nonsense for now. The Dems plan to gerrymander again in 2028. They will stop at nothing and do not care about the people or fairness. This is a bloodsport. The Republicans need to wake up and recognize this fact,” she added.
