The prosecution of former FBI Director James Comey is reportedly being delayed until 2027 as the judge wades through several motions.
One such motion, filed on behalf of Comey by his defense team, seeks to dismiss the case entirely. It alleges that the case is not based on any suspicion of criminal wrongdoing, but on President Donald Trump’s anger toward the former FBI director.
“U.S. District Judge Louise Flanagan declined to set a trial date in the case against Comey, in which prosecutors say that a photo he posted on Instagram of seashells arranged to spell out ‘8647’ amounted to a threat against the president. The term ’86’ is widely considered to be restaurant slang for running out of or canceling an item, and 47 is thought to be a reference to the 47th president,” NBC News reported on Friday.
“The gravity of the charges, pending motions, and the need to provide defense counsel additional time to prepare for trial promote need for continuance,” she wrote in a Friday order.
Comey will not be arraigned until January, despite it being scheduled for Wednesday in New Bern, North Carolina, meaning he has not entered a plea in the case yet.
