A federal judge is putting a pause on California’s anti-masking law that would target federal agents.
Leftists have taken issue with the use of masks by Immigration and Customs Enforcement (ICE) agents during immigration enforcement operations, and Democrats have sought to enact laws forcing agents to bare their faces during their work.
However, Los Angeles-based federal Judge Christina Snyder slapped California’s “No Secret Police Act” with a preliminary injunction on the grounds that it violates the Supremacy Clause and discriminates against the federal government.
“Under the constitutional clause, federal law takes precedence over any conflicting state or local law, rendering the lower-level law unenforceable,” Fox News reported. “Snyder said the ‘No Secret Police’ ruling hinged on California exempting its own state officers while penalizing federal agents.”
In her ruling, Snyder conceded that federal officers are well within their ability to perform the functions of their jobs without the utilization of masks.
“However, because the No Secret Police Act, as presently enacted, does not apply equally to all law enforcement officers in the state, it unlawfully discriminates against federal officers,” she noted.
While this law was paused, the “No Vigilantes Act” is still in effect, which prompts all officers to “show their agency affiliation and a personal identifier, such as a badge number, on their uniforms.” Governor Gavin Newsom celebrated this as a ” clear win for the rule of law.”
“A federal court upheld California’s law requiring federal agents to identify themselves – a clear win for the rule of law. No badge and no name mean no accountability. California will keep standing up for civil rights and our democracy,” he said.
