Women are once again finding out the hard way that there is little they can do to stop biological males from intruding on their spaces.
The ladies of the Kappa Kappa Gamma sorority at the University of Wyoming have had their case dismissed, with prejudice, by U.S. District Judge Alan B. Johnson. This is the second time the case has been dismissed as the ladies attempted to sue their sorority for allowing a biological male, Artemis Langford, who claimed transgenderism, into their group.
According to Johnson, the sorority can interpret the definition of the word woman however they like, and the organization currently “defines women by their gender and not their ‘biological sex.’”
“Nothing in the Bylaws or the Standing Rules requires Kappa to narrowly define the words ‘women’ or ‘woman’ to include only those individuals born with a certain set of reproductive organs, particularly when even the dictionary cited by Plaintiffs offers a more expansive definition,” the judge wrote in his ruling.
Additionally dismissed was the girls’ citation of President Donald Trump’s executive order, which defined “women” as “adult…human females.” Apparently, Johnson doesn’t know what that very basic description means and he even did his best Ketanji Brown Jackson impression.
“We are not entirely sure what this definition means, not having a degree in biology. But even assuming this definition aligned with Plaintiffs’, it only applies to the Executive Branch’s interpretation of federal laws and administration policy. It is not relevant in the world of private contracts, which is where we currently find ourselves,” the judge said.
Ultimately, unless some sort of fraud is committed, or a bylaw is broken, the judge says his hands are tied.
“In short, we are required to leave Kappa alone.”
The plaintiffs are allowed to appeal this decision, but being dismissed with prejudice means that the case can no longer be brought before Judge Johnson’s court. He had previously dismissed the case in 2023, claiming the sorority’s definition of “woman” was not clear enough to make a decision.
“The University of Wyoming chapter voted to admit – and, more broadly, a sorority of hundreds of thousands approved – Langford. With its inquiry beginning and ending there, the Court will not define ‘woman’ today. The delegate of a private, voluntary organization interpreted ‘woman’, otherwise undefined in the nonprofit’s bylaws, expansively; this Judge may not invade Kappa Kappa Gamma’s freedom of expressive association and inject the circumscribed definition Plaintiffs urge.”
