Judge releases four-time-deported criminal illegal alien, convicted sex offender, MS-13 member from ICE custody

Judicial activism’s latest offense featured the release of an illegal alien gang member considered one of the “Worst of the Worst” courtesy of an Obama-appointed judge.

For as much progress as the Department of Homeland Security has made on reestablishing American sovereignty since President Donald Trump’s return to the White House, open-border-friendly jurists have certainly made deportation efforts appear akin to Sisyphus and his rock.

The latest example came out of the District of Minnesota, where U.S. District Judge Susan Nelson ordered the release of a MS-13 gang member, whose rap sheet includes rape and violently resisting arrest, while accusing DHS of “recklessly” sharing his image.

A press release from Homeland Security addressed the order from Nelson, appointed by then-President Barack Obama in 2010, pertaining to El Salvadoran Carlos Antonio Flores-Miguel. In it, Department of Homeland Security acting Assistant Secretary Lauren Bis said, “This activist, Obama-appointed judge RELEASED Carlos Antonio Flores-Miguel, a criminal illegal alien from El Salvador and MS-13 gang member, from ICE custody.”

“This gang member was previously RELEASED by the Biden Administration in 2022. Releasing violent criminals is inexcusably reckless, and now this criminal will be able to perpetrate more crimes against innocent Americans,” continued Bis. “President Trump is enforcing the law and arresting illegal aliens who have no right to be in our country. We are applying the law as written. If an immigration judge finds an illegal alien has no right to be in this country, we are going to remove them. Period.”

Flores-Miguel was arrested in January as part of Operation Metro Surge. At the time, ICE posted, “You wouldn’t want this MS-13 gang member from El Salvador as your neighbor. Today in Minnesota, ICE arrested Carlos Flores Miguel — a four-time-deported criminal illegal alien, convicted sex offender, and assailant of federal law enforcement. Americans are made safer when criminal illegal aliens like him are taken off our streets.”

Regarding his presence in the country, DHS detailed that Flores-Miguel had entered the United States in Sept. 2016, was removed in Oct. 2016, reentered, and was removed again in March 2017, only for the Biden administration to release him into the country in June 2022 after returning in Oct. 2021.

Meanwhile, Nelson’s order took umbrage with DHS for “recklessly” sharing the illegal alien’s image upon his arrest, as well as for characterizing him as one of the “Worst of the Worst” while attempting to see him deported to a third-party nation, since his final order of removal prohibits return to El Salvador.

“Respondents make no attempt to explain why Mexico, or any country, would agree to accept the ‘Worst of the Worst,'” wrote the judge, who also argued, “Petitioner’s unlawful detention has been unnecessarily prolonged by a series of missteps on the part of the respondents.”

As part of her order, Flores-Miguel is expected to remain under supervision and report for check-ins with ICE. Violations are said to place him at risk for future arrest and the loss of his work permit.
