Allegations of insurance fraud continue to dog New York Attorney General Letitia James, even after a federal mortgage fraud case against her was dismissed months ago.
New York’s top prosecutor is facing two federal criminal referrals that were filed on Wednesday, alleging that documents filed with the Illinois-based Allstate Insurance Company and Universal Property Insurance in Florida may have been falsified by James.
“The referrals, submitted by Federal Housing Finance Agency Director Bill Pulte, allege potential insurance fraud tied to properties linked to James and have been sent to U.S. attorneys in Florida and, reportedly, Illinois for review,” Fox News reported. “The criminal referral was transmitted to Jason Quinones, the U.S. attorney for the Southern District of Florida, who will determine whether to move forward with a prosecution. His office would then need to seek a grand jury indictment.”

A DOJ spokesperson told Fox News, “The Department of Justice can confirm that referrals were received by our U.S. Attorney Offices.”
Social media posts by attorney Mike Davis, a longtime ally of President Donald Trump, were cited in the referrals by Pulte, who wrote that James “made false representations” to Universal Property Insurance that the Norfolk home she purchased in 2020 “would be unoccupied five months out of the year.”
“According to the post, this was false,” he wrote. “The house was, in fact, occupied year-round by her niece.”
According to Pulte, James allegedly told the Allstate insurer that the home “would be occupied by a single adult, with no children.”
“Instead, according to the post, she knew the house was actually occupied by four people – three children and her niece,” the filing continued. “As such, it appears Ms. James may have defrauded the Illinois-based insurance company.”
“New York’s top cop is in a world of trouble,” investigative journalist John Solomon told Fox News host Sean Hannity. “This is a very serious legal referral.”

In a statement, James’s attorney clapped back at the allegations, claiming Trump was running a “revenge campaign: against the AG who has made it her mission to put him behind bars.
“Frustrated by repeated failures, where judges and grand juries have rejected their attempts to charge Attorney General James, Trump and his political enablers keep abusing their power to pursue a vendetta against her by trying to rename, refile, and repeat baseless allegations,” attorney Abbe Lowell said in a statement.
“They continue this improper revenge campaign instead of helping bring down the rising cost of living in this country,” Lowell said. “These desperate tactics will fail — just as every previous attempt has failed — and expose an administration that has abandoned its responsibility to the American people in favor of petty political payback.”
