Charles Foehner, a 65-year-old retired doorman in Queens, fatally shot an unhinged would-be mugger named Cody Gonzalez during an attempted robbery in the driveway of his apartment building at around 2 am and now he’s in trouble over his gun collection.

Gonzalez, who was wearing a dark hoodie and jeans, backed off only briefly when he saw that Foehner had drawn a silver revolver. Video showed that he then began swaying back and forth, and making his way toward the older man. Foehner backed up slowly while drawing his gun.
Despite having the revolver pointed directly at him at a nearly point-blank range, Gonzalez continued to weave and sway while clenching something in his right hand before he charged at Foehner.
Foehner reportedly gave the suspect ample opportunity to walk away during the confrontation, but the man refused. He had already broken glass on buildings and threatened to stab Foehner who eventually shot him fearing for his life.
The wounded suspect could be seen on footage desperately running down the parking garage driveway before he collapsed.

After that, Foehner called 911.
According to the New York Post, “The slain robber — who had at least 15 arrests dating back to 2004 and a record of mental illness — died in the street, where a gun was recovered, cops said. They also found a pen in his right hand, which Foehner said he believed had been a knife, according to the sources.”
New York is definitely not a gun-friendly state.
Foehner is not in trouble for killing the man in late May. He’s in trouble for owning at least 30 guns, nine ammunition magazines, and two bullet-proof vests that police say they discovered in the Kew Gardens home. He’s being accused of not having permits for many of them and stockpiling weaponry.
The New York Post attained photos of his cache. The collection had guns that Foehner had obtained over decades. It includes at least 14 rifles and shotguns. Among those was an AK-47. He also owns at least 16 handguns. While the media is calling that “shocking,” it’s really not for a collector or a hunter.
This is not “a shocking cache of at least 30 guns” . If you think it is, you don’t know many gun owners that hunt or go to the range.

Dimitrios Karras, who is the marketing manager at Firearms Unknown in Oceanside, California, estimated that Foehner’s collection was worth somewhere between $15,000 to $20,000.
“This is all pretty standard stuff,” Karras appropriately noted. “This probably took him years to do, but there’s nothing overly impressive.”
Foehner is being charged with eight counts of illegal weapons possession by Queens District Attorney Melinda Katz. She’s going to throw the book at the man including a charge for using an unlicensed gun during the fatal shooting and for keeping an “armory” filled with many unlicensed firearms, ammunition, and body armor.
This is insanity. #CharlesFoehner had every moral right to kill the mugger. When you attempt to steal from another, you zero-out the value of your worthless life; if you’re killed, blame no one but yourself. #progressivismDestroys #LiberalismIsAMentalDisease https://t.co/r5Q1ff1mpT

Foehner’s attorney, Margaret Lin, told Queens Criminal Court Judge Jerry Lannece that the shooting was “a total aberration” in her client’s life.
The authorities had thrown Foehner into Rikers earlier in June. He’s out now on $50,000 bail and will appear in court on Aug. 16, according to the New York Post.
Judge Iannece showed Foehner no sympathy during his first court appearance, doubling the amount initially requested by the Queens District Attorney’s Office for bail.
“The defendant was on the street with a loaded, unlicensed gun,” Iannece declared, according to ABC7 NY. “There are too many shootings in this city! The court is quite concerned with what we see.”
