Former President Joe Biden was just handed a crushing defeat at the hands of an appeals court in Washington, D.C.
Biden has been trying to prevent the release of audio recordings shared with a writer that were used for his 2017 memoir “Promise Me, Dad.” Since the publication of special counsel Robert Hur’s report that categorized the former president as a “sympathetic, well-meaning, elderly man with a poor memory” who had “diminished faculties in advancing age,” Republicans have pushed for the release of those tapes. The rationale is that American voters deserve to know the kind of person who was leading their country for four years, under serious cover from both the Democratic Party and the mainstream media.
For his part, Biden has attempted to block the release of the audio files, but on Monday those efforts received a massive blow by the three-judge panel of the US Court of Appeals for the District of Columbia. In a 2-1 ruling, it was decided that there is a “substantial” public interest in the information and the former president “has not shown a likelihood that the requested materials must be withheld from disclosure.”
“We conclude that any remaining incursion on personal privacy from disclosure of the now-redacted materials likely does not outweigh the public interest in disclosure,” the majority continued.
The dissent was written by the Biden-appointed Judge Florence Pan.
“The conversations at issue took place in Biden’s home, and the recordings of them were obtained by the government in the course of a criminal investigation that did not lead to an indictment,” she argued.

The interviews were recorded at Biden’s home in 2016 and 2017 with author Mark Zwonitzer.
They took place when Biden was Vice President and before his 2020 campaign, and were meant to remain private, the former President’s legal team has argued.
Zwonitzer admitted to deleting the audio files during Hur’s investigation, claiming he was afraid of getting hacked.
The opinion will be stayed until August 3, which will allow Biden’s legal team an opportunity to appeal the decision.
