Attorney General Pam Bondi is cautioning blue state officials to comply with President Donald Trump’s executive orders concerning transgender athletes.
Conservatives have been concerned about the spike in transgender athletes competing in female sports leagues, sometimes excelling far beyond what the biological women had been able to achieve. This has led to many calling on Trump to level the playing field, which he has done with a series of executive orders barring trans participation in women’s sports. Bondi put Maine, California and Minnesota officials on notice Tuesday, vowing swift legal repercussions for those who defy these orders. She made the promise in letters addressed to Minnesota Attorney General Keith Ellison (D), Maine’s Democrat Governor Janet Mills, California Interscholastic Federation Executive Director Ron Nocetti and executive director of the Minnesota State High School League (MSHSL) Erich Martens.
“This Department of Justice will hold accountable states and state entities that violate federal law,” she warned, adding that it doesn’t matter if “state law allows, or even requires, state athletic associations or other similar entities to require girls to compete against boys in sports and athletic events. Where federal and state law conflict, states and state entities are required to follow federal law.”
The officials in these states have previously threatened to defy Trump’s orders, citing their state anti-discrimination laws. Trump and Mills even went at it during the National Governors Association session over the topic, after Mills told the president she would “see [him] in court” at a White House event the previous evening.
“The CIF and MSHSL have said they will follow state laws that allow transgender students to compete in sports consistent with their gender identity, and Ellison, in an opinion issued last week, said Trump’s order violates the Minnesota Human Rights Act, which prohibits discrimination based on gender identity,” The Hill reported.
Ellison reasons that Trump’s EO cannot take precedence over state law because it lacks “the force and effect of law.” The education department is currently investigating Minnesota, California and Maine for potential violations of Title IX for failure to comply with the president’s orders.
Bondi released a statement to the press advising that the Trump administration “does not tolerate state officials who ignore federal law.”
“We will leverage every legal option necessary to ensure state compliance with federal law and President Trump’s executive order protecting women’s sports.”
