A New York City jury found Daniel Penny not guilty in the accidental chokehold death of Jordan Neely on Monday and he could soon sue Manhattan DA Alvin Bragg who upended his life with the “malicious” prosecution.
Last year, the former Marine was on his way to work out at the gym when the black thug with a history of violence went off on passengers on a Gotham subway train. He acted heroically to neutralize the threat to the terrified riders by subduing Neely who unfortunately died as a result of the encounter.
Even though Bragg played dirty with his racially-charged case, jurors saw through it and gave Penny his freedom, a blow to the Soros-backed prosecutor who also brought charges against President-elect Donald J. Trump in the Stormy Daniels “hush money” case.
Now there could be a price to pay for Bragg and in an appearance on Fox News, Penny’s attorney suggested that the overstuffed Democrat may get his own day in court.

“It’s not necessarily even about breaking the law,” Steven Raiser told the “Fox & Friends” crew on Wednesday’s edition of the popular morning show. “It’s blurring ethical boundaries and failing to act in the manner in which you are expected, because of your office.”
Bragg moved quickly to bring charges against Penny after the May 1, 2023 incident after pressure from black activists, including MSNBC host Rev. Al Sharpton who demanded that Neely be avenged.
“It was clear that there was a fear that if an arrest wasn’t made – and made very quickly – that there might be rioting in the streets, and that that may ultimately look very bad for District Attorney Alvin Bragg,” Raiser said. “And if that in fact happened, that could affect his re-election.”
He told “Fox & Friends” that NYC Chief Medical Examiner Dr. Jason Graham could also be named. Graham signed off on Neely’s death being a homicide as a result of strangulation before toxicology reports were completed.
“He was appointed by Mayor Adams, same political party as Alvin Bragg,” he said, referring to the embattled Democrat Eric Adams. “There was collusion there, and, I mean, the collusion began from the very beginning of this case and all the way through. The district attorney needed the medical examiner and needed the medical examiner to act quickly, and he did just that.”
“There were some highlights that were put out there, quite extensively, in regards to this office’s practice of not prosecuting crime, and some very serious cases to talking about restorative justice and such, which, by the way, in some circumstances, that’s a great thing,” Raiser said of Bragg’s priorities.
“But some brutal cases of an individual who attacked an 80-year-old man, mugging him and punching him and ultimately killing him, and yet you’re going to go after full-throated against my client, who you admit did a laudable thing and is a fine young man? Despicable,” he added.
