An activist attorney with aspirations for higher office wound up triggering a mistrial for alleged Antifa terrorists in Texas over her t-shirt.

Some seven months after the Prairieland Detention Center in Alvarado, Texas, southwest of Dallas, was attacked by an alleged Antifa cell, trial proceedings for nine defendants were quickly shut down Tuesday in a North Texas courthouse. The cause for the mistrial, as decided by U.S. District Judge Mark Pittman, was a defense attorney’s t-shirt depicting images equivalent to the prosecution showing up in a shirt with the president “riding an eagle with an ICE flag.”
“I don’t know why in the world you would think that’s appropriate,” the Trump-appointed judge told defense attorney MarQuetta Clayton, counsel for defendant Maricela Rueda, currently seeking a judgeship in Tarrant County.
According to the Fort Worth Star-Telegram, Pittman became aware of the images on the shirt, depicting Rep. Shirley Chisolm (D-NY) — the first black congresswoman — Martin Luther King Jr., and other civil rights movement-related images after Clayton had been questioning the panel for over 20 minutes. “This has to be a first in the history of American jurisprudence, I would think.”
“I’m left with no other choice,” he added in declaring the mistrial in the case of nine suspects alleged to have been involved in terrorism and attempted murder at the Texas immigration facility on July 4, 2025, where Alvarado Police Department Lt. Thomas Gross was shot in the shoulder, the first terrorism case against an alleged Antifa cell in American history.
Pittman went on to liken Clayton’s t-shirt, allegedly worn to honor the passing of Rev. Jesse Jackson and seen inside out as she left the courthouse, to a member of the prosecution coming to the trial in a shirt depicting “Donald Trump riding an eagle with an ICE flag.”

Speaking with CBS News, prospective juror Harrison Stables said, “It felt a little off like part of their strategy, after she did that, and the judge was like, ‘What are we doing?’ It all just felt disorganized because she pulled out a sign that wasn’t approved by the court. The court had no idea that she was bringing in a sign. It just felt all disheveled.”
As had been previously reported, seven other defendants had already pled guilty to charges related to the Independence Day attack at the Prairieland Detention Center.
If convicted, the defendants face anywhere from 10 years to life in prison for federal charges in addition to the potential consequences for possible convictions on state charges.
Pittman went on to detail that a show-cause hearing would be scheduled for the attorney to explain why she should not be sanctioned. The judge estimated the mistrial would cost taxpayers hundreds of thousands of dollars, and jury selection would begin anew next week.
On that front, some argued in favor of consequences for Clayton, including having her “footing that bill, not the taxpayers.”
