Democrat law firm seeks to overturn Wisconsin high court, allow absentee ballot drop boxes in 2020 redux

Democrats in Wisconsin are looking to overturn a state Supreme Court decision that prohibits absentee ballot drop boxes.

Last year, Wisconsin’s then-conservative Supreme Court, following claims from former President Donald Trump that absentee voting contributed to voter fraud in the state, ruled that the controversial drop boxes will only be allowed in election offices.

On Thursday, a lawsuit was filed by the progressive national firm, Elias Law Group, against the Wisconsin Elections Commission alleging that the ballot box ban “severely burdens the right to vote.”

“Without the opportunity to drop off their absentee ballots at drop boxes, voters must instead rely on the U.S. Postal Service—and its unsecured mailboxes—to deliver their absentee ballot and simply hope that the ballot arrives by election day,” the suit argues. “The delivery of mail by the U.S. Postal Service is entirely outside the control of voters.”

Filed on behalf of Priorities USA and the Wisconsin Alliance for Retired Americans, the lawsuit also “challenges Wisconsin’s requirement that every absentee ballot be signed by an adult witness regardless of whether a voter lives alone, is homebound, or faces other barriers to satisfying the provision,” according to the press release. “The filing argues that as a result of the unnecessary requirement, the right to vote by absentee ballot is unfairly based on the ability to find a willing third party.”

And finally, the suit “seeks relief for voters from the arbitrary deadline to cure defects in their ballot.”

“While the current law allows voters to cure nonmaterial defects in their absentee ballots, it must be done before 8 p.m. on election day,” the Elias team explains. “In the filing, it is noted that the deadline not only deprives countless voters of the right to cure their ballots, it also serves no purpose. In comparison, the deadline to correct provisional ballots is the Friday following election day yet there is no reason why absentee ballots should be treated differently.”

If you’re wondering why the Elias Law Group is ringing a bell, it’s because the founding partner of the firm, Marc Elias was the attorney of record and general counsel for Hillary Clinton’s 2016 presidential campaign.

As BizPac Review reported back in Oct. 2017, it was Elias who hired Fusion GPS to compile the notorious Trump dossier.


Elias was also tied to the Hopewell Fund, “which spent almost $150 million together preceding the 2020 election in ‘get-out-the-vote’ efforts targeting demographics that lean Democratic,” BizPac reported in Dec. 2022. “The fund also bankrolled a Democrat-aligned legal group, Democracy Docket Legal Fund, led by Democratic Party election lawyer Marc Elias.”

And, fun fact: If you follow the Hopewell money trail, it leads back to Arabella Advisors and the Biden administration.

According to Influence Watch:

Arabella’s nonprofit network has implemented over 300 different “pop-up” projects targeting a range of issues, including net neutrality, free speech, abortion access, Obamacare, and President Donald Trump’s judicial nominees, and was highly active in funding pro-Democratic Party advertisements in the 2018 and 2020 elections. Its groups were also active in trying to manipulate the outcome of the 2020 U.S. Census in left-leaning states and the subsequent 2021-22 redistricting process, when state legislative and congressional districts were redrawn by state legislatures.

Multiple former Arabella employees have also been traced to the Biden administration.

 

In 2020, fewer than 21,000 votes in Wisconsin handed President Joe Biden the victory over Trump, who took the state in 2016 by slim margins, The Examiner noted, citing U.S. Census Bureau data to add, “Absentee voting skyrocketed in 2020 during the coronavirus pandemic, with 43% of voters casting ballots by mail compared to 21% of mailed ballots in 2016.”
