The Department of Justice will reportedly be dropping its case against billionaire Elon Musk’s SpaceX, according to a filing from Thursday.
In the filing, lawyers for the DOJ appealed to the judge to end a pause on proceedings in the action against the company, which would allow them to file a notice of dismissal. They also declared intent to dismiss the case with prejudice, meaning SpaceX cannot be brought back to court on the same charge.
In August 2023, Musk was sued by the DOJ under President Joe Biden over allegations that SpaceX “routinely discouraged asylees and refugees from applying and refused to hire or consider them, because of their citizenship status, in violation of the Immigration and Nationality Act (INA).” The initial legal filing also alleged that SpaceX “wrongly claimed that federal laws and regulations restricted the company to only hiring U.S. citizens and lawful permanent residents, also known as green card holders,” according to Fox News.
In response, Musk took to social media to declare that the “DOJ needs to sue themselves!” in a post sharing that the Bureau of Prisons also made United States citizenship a requirement of hiring.

“SpaceX was told repeatedly that hiring anyone who was not a permanent resident of the United States would violate international arms trafficking law, which would be a criminal offense,” Musk wrote in a follow-up post. “We couldn’t even hire Canadian citizens, despite Canada being part of NORAD! This is yet another case of weaponization of the DOJ for political purposes.”
“SpaceX follows strict policies and procedures to both ensure compliance with all export control laws and regulations and also prevent any unlawful discrimination,” the company said in its own defense.
