Former top DOJ official exposes motion to dismiss possibility in Trump indictment

A former top Department of Justice (DOJ) official under the Trump administration has read the federal indictment of the former president, and he suggests there are grounds to dismiss contained in just the first few pages of the “outrageous” document.

According to the DOJ’s website, Jeffrey (“Jeff”) Clark was appointed by then-President Donald Trump “to be the Assistant Attorney General of the Environment and Natural Resources Division (ENRD) on June 7, 2017. He was confirmed by the U.S. Senate on October 11, 2018 and sworn into office on November 1, 2018. The President also directed that Mr. Clark serve as well as the Acting Assistant Attorney General for the Civil Division effective September 3, 2020.”

On Twitter, Clark focused on the “leaks that preceded the indictment.”

“I’m beginning to read the indictment against Trump,” he began. “But even three pages in, it’s clear that the leaks that preceded the indictment are far too close to what is actually being pleaded by DOJ to be a coincidence.”

As BizPac Review reported, CNN first broke the news last week of a 2021 audio recording in which Trump reportedly admits he did not declassify some of the “highly confidential” materials seized at his Mar-a-Lago home.

On Friday, prior to the details of the indictment being released, CNN dropped a transcript of a portion of the conversation Trump had with writers at his Bedminster, New Jersey, golf club.

“This totally wins my case, you know,” Trump said, according to CNN. “Except it is like, highly confidential. Secret. This is secret information. Look, look at this.”

Even before the transcript was released, MSNBC was calling the recording “evidentiary manna from heaven.”


“In paragraph 6a on page 3 [of the indictment] we hear about the recording of the Bedminster call, which the MSNBC’s of the world have been beating a dead horse about for quite a while based on such leaks,” Clark tweeted. “This means that Trump lawyers could not possibly be the source of the leaks.”

In July 2021, at Trump National Golf Club in Bedminster, New Jersey (“The Bedminster Club”), during an audio-recorded meeting with a writer, a publisher, and two members of is staff, none of whom possed a security clearance, TRUMP sowed and described a “plan of attack” that TRUMP said was prepared for him by the Department of Defense and a senior military official. TRUMP told the individuals that the plan was “highly confidential” and “secret.” TRUMP also said, “as president I could have declassified it,” and, “Now I can’t, you know, but this is still a secret.”

 

In its release of the transcript, CNN reported, “Trump was complaining in the meeting about Chairman of the Joint Chiefs of Staff Gen. Mark Milley. The meeting occurred shortly after The New Yorker published a story by Susan Glasser detailing how, in the final days of Trump’s presidency, Milley instructed the Joint Chiefs to ensure Trump issued no illegal orders and that he be informed if there was any concern.”

“Ergo,” Clark surmised, “the leaks are coming from DOJ.

“They must be investigated and punished,” Clark stated. “Also, this is grounds for granting a motion highlighting jury pool poisoning and dismissing the indictment before it reaches even its one-month birthday.”

“All of this is so outrageous; it shocks the conscience,” he added. “It’s fundamentally anti-American.”

And Clark should know something about “anti-American” behavior.

A year ago, in June of 2022, the FBI raided his home, dragged him into the street, and seized his electronics in connection with the Jan. 6 inquisition.

“I just think we’re living in an era that I don’t recognize,” Clark told then-Fox News host Tucker Carlson at the time, “and increasingly, Tucker, I don’t recognize the country anymore with these Stasi-like things happening.”

After reading the indictment, Clark tweeted, “Trump Witch Hunt Number … what?”

“I’ve lost count,” he stated. “Let’s call it Trump Witch Hunt #99.”
