Illegal immigrant accused of killing college soccer player, girlfriend had prior charge dismissed

Adding fuel to the immigration debate is a new report on an illegal immigrant who is accused of driving while impaired and killing a young North Carolina couple.

“Juan Alvarado Aguilar, appearing in court with the assistance of a Spanish translator, faces two counts of felony death by vehicle and one count of driving while impaired in connection with the Jan. 16 crash on Amity Hill Road that killed Fletcher Harris, 20, and Skylar Provenza, 19,” WCNC reported.

But as the court proceedings played out, Fox News noted that documents show the 37-year-old “was charged with driving while impaired in Cabarrus County on Nov. 5, 2020. The case was dismissed with leave by the district attorney, a procedural move under North Carolina law that removes a case from the court docket without terminating it and allows prosecutors to reinstate the charge under limited circumstances.”

“Prosecutors revealed Alvarado Aguilar has two prior failures to appear in court and a prior DWI charge on his record. An ICE detainer has also been placed on him,” according to WCNC.

They were also concerned about Alvarado Aguilar being a flight risk and asked the judge on Tuesday to increase the bond from $250,000 to $2 million. The judge went beyond the request, setting bond at $5 million.

“I’m very concerned about his appearance in court and the facts of this case,” the judge said, according to WCNC.

North Carolina State Highway Patrol troopers had reported a strong alcohol odor on the driver when they arrived at the scene.

“The trooper noted that the odor overcame all the other odors that were there at the scene of the crime, including burnt rubber and oil,” prosecutors told the court.

Court testimony showed Alvarado Aguilar admitted he was the driver, and prosecutors relayed how troopers observed the man stumbling at the scene and even falling into one of the officers.

“Each felony death by vehicle charge carries a maximum sentence of 240 months, or 20 years. The DWI charge carries a maximum of three years in custody,” WCNC noted.

Border policies and the nation’s weak immigration policies were blamed for the tragedy that could have been avoided.

“The lives of Fletcher Harris and Skylar Provenza were senselessly taken by an illegal alien driving while impaired,” North Carolina House Speaker Destin Hall said in a statement on the death of the young soccer player and his girlfriend.

“He had no business being in our country, and two more young lives have been stolen by open border policies,” Hall added.

“Fletcher and Skylar are the latest victims of NC’s deadly sanctuary policies,” Republican Rep. Mark Harris of North Carolina wrote in a post on X.

“They were allegedly killed by an illegal alien with a prior DUI in a head-on crash. They should still be here—but radical pro-crime Democrats protect criminal aliens instead,” he added.

Sen. John Cornyn (R-TX) and other lawmakers are pushing legislation, dubbed the Stop Illegal Aliens Drunk Driving Act, that would deport illegal immigrants who have been convicted of deadly drunk driving, classifying fatal DUI offenses as aggravated felonies, Fox News reported.

“Zero mercy should be shown to illegal aliens who not only defy our laws by unlawfully entering the country, but also take it a step further to drive drunk, threatening American lives,” Cornyn said in a statement earlier this month. “By strengthening current immigration law to hold these offenders accountable, our bill sends a clear message: If you enter the country illegally and harm innocent citizens, we will find you, we will punish you, and we will make sure you never step foot on American soil again.”
