A number of rabidly socialist Democrats may be on a glide path to the House of Representatives, but a big surprise could await them when they get to Washington.
The far-left radicals who toppled incumbents in a string of shocking summer primary upsets have now advanced to the general election and will serve as reinforcements for the socialists who have already established a beachhead in Congress despite their disdain for the nation’s founding principles as espoused in the U.S. Constitution.
It is a document that incoming members are required to swear an oath to uphold before they can officially become House lawmakers, an oath that traditionally is taken by all 435 members en masse and is led by the Speaker of the House.
Republican lawmakers are eyeing a little-known congressional maneuver that could block Democratic Socialists of America members from being sworn into the House — even if they win their elections next week.
The move hinges on the oath of office. Lawmaker-elects must swear to uphold the Constitution before taking their seat. But under this procedure, any member-elect can challenge another’s right to be sworn in by presenting evidence that person would not honor that oath. The DSA’s own platform, which calls for scrapping the current Constitution and drafting a new one, could serve as that evidence.
Rep. Keith Self, R-Texas, told Fox News Digital he’s considering invoking the challenge. Rep. Tim Burchett, R-Tenn., has already said he plans to use it against incoming Rep. Darializa Avila Chevalier. The move would face serious legal headwinds — the Supreme Court ruled in 1969 that the House cannot exclude an elected member who meets constitutional age, residency, and citizenship requirements.

But Fox News reports that there is “an argument circulating in conservative circles posits that any member-elect can challenge another member-elect’s right to be sworn in, provided they have compiled evidence that that person would not uphold their oath. That would then lead to House-wide deliberations followed by a vote on whether that member-elect has a right to be sworn in.”
The Democratic Socialists of America (DSA) – an organization which some of the likely incoming Democrats belong to – states in its platform that the Constitution should be thrown into the trash and replaced with a new one.
And while Speaker Mike Johnson (R-La.), the current GOP House leader, has rejected rumors that incoming Democrats would not be seated as “nonsense” and that Republicans are going to “follow the law,” some lawmakers are signaling that they aren’t going to just roll out the welcome mat for the socialist newbies.
“You cannot swear an oath to support and defend the Constitution while actively working to destroy it. The oath of office is not just words you say at a ceremony. It is a belief. It is an oath to our country and our fellow countrymen,” Rep. Keith Self (R-Texas) told Fox News Digital.
“The House has both the authority and the duty to ensure that anyone who takes that oath does so in good faith, without mental reservation or purpose of evasion,” the congressman continued. “As DSA candidates and the Red-Green Alliance gain ground, we must enforce the Constitution as written or risk allowing people committed to replacing it to take seats of power under false pretenses.”
The Lone Star State Republican’s reference to the “Red-Green Alliance” is the term used to describe the team-up between radical Islamic groups and militant left-wingers who are united by their hatred for America.
“Anyone who has personally embraced the destruction of the Constitution has no business being sworn in to uphold it,” Self said.
“According to an analysis by the Center for Renewing America, a challenge to a member-elect’s fitness to take the oath of office can be followed by the House speaker asking them to step aside while the debate begins,” Fox News Digital reported.
“The objecting member should place the documentary record before the House, and the House should debate whether that evidence establishes that the member-elect remains committed to destroying the constitutional order,” the Washington, D.C.-based conservative think tank states.
A vote would then be taken on a resolution that “establishes the member-elect’s commitment to destroying the constitutional order,” which could prevent the incoming member from being sworn in.
Another GOP lawmaker, Rep. Tim Burchett (R-Tenn.), previously told the New York Post that he would try to block New York City socialist Darializa Avila Chevalier – who makes AOC look like Margaret Thatcher – from being sworn in over her flagrant disrespect for the American flag, which she boasted about using as a napkin.
“You take an oath to uphold the Constitution, and you’re pretty much disavowing it right there. I just think we’ve lost our compass,” he said.
