‘That seems desperate’: Hunter Biden legal team trying to subpoena Trump

Lawyers for Hunter Biden are looking to a federal court to subpoena documents from former President Donald Trump and other former Justice Department officials for their “incessant, improper and partisan pressure” against him.

U.S. District Judge Maryellen Noreika was asked by Hunter Biden’s attorney Abbe Lowell and the legal team on Wednesday to examine records to determine if former Attorney General Bill Barr, former acting Deputy AG Richard Donoghue, and former acting AG Jeffrey Rosen along with Trump applied political pressure in a criminal case against President Joe Biden’s son.

The papers filed with the Delaware federal court requesting the subpoenas are seeking any documents discussing the younger Biden, including any journal entries made by the named parties. Trump was still president in 2018 when the investigation into Biden’s taxes and a gun purchase began. Though he had agreed to what was being called a “sweetheart deal” to avoid prosecution on the charges, that deal fell apart.

The filings by Biden’s legal team Wednesday claim that there were “certain instances that appear to suggest incessant, improper, and partisan pressure applied” by then-President Trump on members of his Justice Department and also cited comments made by Trump in public, as well as information from the January 6 committee in Congress and even excerpts from Barr’s book in which he claimed Trump had pressured him about the Biden investigation.

“The initial investigation was born out of a wider probe into Mr. Biden’s taxes and foreign business dealings. Public reporting reveals certain instances that appear to suggest incessant, improper, and partisan pressure applied by then-President Trump to Messrs. Rosen, Donoghue, and Barr in relation to an investigation of Mr. Biden,” the lawyers wrote in the court filing.

“Mr. Biden seeks specific information from three former DOJ officials and the former President that goes to the heart of his defense that this is, possibly, a vindictive or selective prosecution arising from an unrelenting pressure campaign beginning in the last administration, in violation of Mr. Biden’s Fifth Amendment rights under the Constitution,” the filing continued.

“It is clear no measure of charges against [Hunter] Biden will ever be enough to appease Chairman Comer and Smith and their MAGA allies. As anyone can readily tell, it is not just pressure from within the Trump-era Executive Branch that is the problem; it is also incessant, unrelenting outside interference from congressional Republicans and their allies in the prosecutorial process,” they added.

The requested subpoenas are seeking “All personal records (including diaries, journals, memoirs, memoranda, or notes) from the relevant time period discussing or concerning Hunter Biden, including, but not limited to, reference to any formal or informal decision, discussion, or request to investigate or prosecute Hunter Biden.”

The filing notes that Biden is after “specific information from three former DOJ officials and the former president that goes to the heart of his defense that this is, possibly, a vindictive or selective prosecution arising from an unrelenting pressure campaign beginning in the last administration, in violation of Mr. Biden’s Fifth Amendment rights under the Constitution.”
