TIPP: AG Garland should act to restore Americans’ faith in the DOJ

The recent “Twitter Files” revelations make a compelling case for a special counsel to look into the FBI’s actions leading up to the 2020 election.

The FBI got Hunter Biden’s laptop from Delaware computer repair shop owner John Paul Mac Isaac in December 2019. Nine months later, Mac Issac gave a copy of the laptop to Rudy Guiliani, who gave it to the New York Post.

The FBI mischaracterized the laptop as a Russian operation and pressured Twitter to thwart the Post story. FBI Agent Elvis Chan and former top FBI lawyer Jim Baker who worked as Twitter’s deputy general counsel, were crucial players in spiking the Post story.

Did the FBI use the pretext of guarding elections against foreign interference to suppress free speech on Twitter?

If so, why did the FBI mislead Americans and refuse to conduct a full investigation, despite having the laptop since December 2019?

The DOJ can’t investigate the FBI since the bureau is a part of it. Further, an Inspector General investigation won’t be enough.

Recall that Inspector General Michael E. Horowitz investigating the FBI, despite chronicling questionable FBI actions, drew lukewarm conclusions. That led many to spin Horowitz’s findings as absolution for the FBI. Individuals within the FBI and the DOJ had worked to defeat Trump in 2016. When Trump won, the same folks pursued an investigation to undermine the Trump presidency. The legal system failed to hold anyone accountable for the Russia hoax.

The special counsel appointed by AG Garland must investigate the relationship between Big Tech companies and the FBI and their role in the 2020 elections.

Two special counsels are needed due to the scope of the issues. One to investigate FBI actions in the 2020 elections and the other to investigate Hunter Biden’s business dealings.

President Biden unequivocally stated during the 2020 presidential debates that he knew nothing about his son’s business.

But, since then, a plethora of evidence has emerged contradicting Biden’s claim.

The vexing questions here are: Did Hunter Biden parlay his connection to Vice President Biden to promote his business? What is the extent of President Biden’s involvement in his son’s business dealings?

The DOJ is becoming a laughing stock. Days after President Trump announced his 2024 run; AG Merrick Garland appointed a special counsel to investigate him.

AG Merrick Garland reports to President Biden. Delaware U.S. Attorney David Weiss is currently investigating Hunter Biden. He reports to AG Garland and is part of the Department of Justice. David Weiss’s investigation began before the 2020 election and is continuing.

Investigating your boss is a sensitive issue with an inherent conflict of interest. A Federal appeals panel of judges appointed Kenneth Starr to investigate President Clinton to prevent such a scenario. Deputy AG Rod Rosenstein appointed Robert Mueller to investigate President Trump. A special counsel keeps out the issue of conflict of interest and offers an unbiased probe.

David Weiss must be made the second special counsel and be independent to direct the investigation free of conflict of interest.

The issue will be a top priority for investigation by the incoming GOP. In all likelihood, the media and Democrats will brand it as a “partisan investigation.” Amid the political theater, a special counsel could bring some objectivity.

In a recent TIPP Poll of 1,351 Americans, only 37% follow the Hunter Biden laptop story. But, 71% of those following the story think that the outcome of the 2020 Presidential election might have been different had the public known the truth about the story.

Seventy percent of those following the story believe that the AG must appoint a special counsel to investigate Hunter Biden’s laptop-related issues. Those who subscribe to this notion include 57% of Democrats, 84% of Republicans, and 69% of independents.

Attorney General Garland must demonstrate the same alacrity he had when appointing a special counsel for President Trump. He must appoint a special counsel to investigate the FBI’s role in the 2020 elections without delay.

Garland must also designate David Weiss as a special counsel for the Hunter Biden probe. Such a measure is necessary to restore faith in the country’s judiciary and investigative agencies.

Failing to do so, we can only conclude that he is playing defense to protect President Biden.
