A new Justice Department lawsuit against a university over tuition rates meant more than half the nation faced challenges over allegedly favoring illegal aliens over American citizens.
Last fall, congressional Democrats firmly planted their globalist flag with a record-breaking government shutdown in part aimed at subsidizing health insurance benefits for illegal aliens. Now the University of Delaware has been slapped with a DOJ lawsuit over claims it violated federal law by offering illegals in-state tuition rates while Americans from outside Delaware paid nearly $27,000 more per year.
“This Department of Justice’s efforts will not cease until we have challenged every state law or university policy that gives preferential treatment to illegal aliens over our Nation’s own citizens,” said Associate Attorney General Stanley E. Woodward Jr. in a statement accompanying the press release Thursday. “Congress long ago made clear that states cannot give reduced tuition to illegal aliens not available to all Americans. When a state Attorney General allows her own state to violate federal law, this department must step in to enforce it.”
The Department is challenging the University of Delaware’s policy which grants in-state tuition for illegal aliens while denying reduced tuition to U.S. citizens. This policy unconstitutionally discriminates against U.S. citizens who are not afforded the same reduced tuition rate, which is in direct conflict with federal law.

According to the lawsuit, the school charges illegal aliens the $15,740 in-state rate per year compared to the $42,470 rate for non-Delaware students. The difference amounts to more than $100,000 for a four-year program.
Based on 8 U.S.C. §1623(a), the suit alleges the university violates federal law for putting the needs of illegal aliens ahead of citizens. The legal challenge makes Delaware the 25th state represented in suits from the DOJ on similar grounds, as challenges already enjoined Illinois, Kansas, Kentucky, Nebraska, Oklahoma and Texas while declaring their laws unconstitutional.
Cases remain pending in Arizona, Arkansas, California, Colorado, Connecticut, Hawaii, Maryland, Massachusetts, Minnesota, New Jersey, New Mexico, New York, Oregon, Rhode Island, Utah, Vermont, Virginia, Washington and Washington, D.C.
Many of those states were also named in recent efforts by the Department of Homeland Security to better address national sovereignty through mass deportations. U.S. Immigration and Customs Enforcement (ICE) recently indicated it “initiated a nationwide public safety surge in sanctuary cities where our brave officers will be targeting criminal illegal aliens–many released from jails by sanctuary politicians–including murderers, rapists, child predators, and gang members.”
That statement — which includes efforts in California, Colorado, Connecticut, Delaware, Illinois, Minnesota, New York, Oregon, Rhode Island, Vermont, Washington and Washington, D.C. — came with clarification that ICE would still be arresting non-criminal illegal aliens after an encounter with an illegal alien in Texas resulted in an officer-involved shooting.
Regarding the suit brought by the Justice Department, the University had little to say in a statement that read, “The University of Delaware is aware of the complaint filed last week by the U.S. Department of Justice, and we are reviewing it carefully. Because this is a pending legal matter, we will not comment further at this time.”
