Biden judicial nominee’s troubling history of ‘woke’ behavior emerges ahead of confirmation

President Joe Biden’s latest judicial nominee is reportedly a radical, surprise, surprise, and she’s one who could be confirmed as soon as next week.

U.S. Court of Appeals for the Second Circuit nominee Maria Araujo Kahn, who currently serves on the Connecticut Supreme Court, has a history of “woke” behavior and rhetoric, according to reporting by the Washington Free Beacon.

Indeed, the Beacon notes that she’s a “longtime diversity trainer who has argued for curtailing the First Amendment and conducted training sessions that say ‘microaggressions’ can ‘kill you.'”

For example, in a 2020 opinion, she upheld a “breach of the peace” conviction against a white gentleman who’d yelled a racial slur at a black parking attendant who’d given him a ticket.

She upheld it by citing the fighting words doctrine, a rule that “allows government to limit speech when it is likely to incite immediate violence or retaliation by the recipients of the words,” according to The First Amendment Encyclopedia.

However, she went on to complain about the doctrine “on the grounds that some groups are unlikely or unable to physically retaliate against insults,” according to the Beacon.

This meant they “must endure a higher level of offensive speech before being afforded legal remedies.”

Though she didn’t clarify how she’d change the law to ameliorate this, she made it clear she does want to change the First Amendment because right now racists can “verbally assault certain oppressed groups without fear of criminal prosecution.”

“Since 2013, she has also delivered at least a dozen diversity trainings and presentations to lawyers across the country, with titles like ‘Cultural Competence, Implicit Association and Racial Anxiety,'” according to the Beacon.

To prepare for her training sessions, the lawyers were asked to watch an animated video called “How Microaggressions Are Like Mosquito Bites.”

The video depicts a giant mosquito making allegedly offensive remarks to minorities and then sucking the life out of them.

“Some mosquitoes carry truly threatening diseases that can mess up your life for years. And other mosquitos carry strains that can even kill you,” a narrator announces.

The video eventually cuts to the mosquito holding a gun next to a body.

“I felt threatened. It looked like he was up to trouble, ok?” the mosquito then tells a cop.

Another clip from the odd program “depicts a black woman murdering several mosquitos with a flamethrower after they ask to touch her hair,” according to the Free Beacon.

All this is relevant because as a judge on the Second Circuit, Kahn would “have a say in some of the influential judicial cases in the county—and would bring to the court a controversial view of the First Amendment,” the Beacon notes.

“The Second Circuit’s docket is unusually high-profile, in part because of its jurisdiction over New York state, and often includes prominent free speech cases. In 2022, for example, the Second Circuit upheld a New York state official’s right to discourage banks from doing business with the National Rifle Association,” according to the Beacon.

“In 2019, it ruled on First Amendment grounds that former president Donald Trump could not block critics from his personal Twitter account. If Kahn joins the Second Circuit, she could hear challenges to New York’s controversial social media law, which requires platforms to report ‘hateful conduct’ to the state,” as reported by the Beacon.

Unfortunately, Kahn’s far-left views are in line with the new breed of justices being confirmed to the courts.

“Last year, for example, the Washington State Supreme Court flipped the burden of proof for claims of racial bias in civil trials, forcing attorneys accused of stereotyping to show that their language did not activate any juror’s ‘implicit bias,'” according to the Beacon.

“Lawyers and law professors said that the negative would be impossible to prove and that the court had set a chilling precedent. David Bernstein, a professor of constitutional law at George Mason University, called the decision ‘batshit crazy,'” the Beacon notes.

Federal Trade Commission nominee Rebecca Slaughter reportedly also boasts radical views. In fact, she’s recommended that the U.S. follow South Africa’s “racial equity” lead and start going after businesses that have so-called “racially skewed” ownership.
