Border Patrol under Biden exposed for ‘final order of removal’ sleight of hand

Simple math exposed a bogus claim from the Biden administration about final orders of removal and lacking capabilities of Border Patrol.

Throughout President Joe Biden’s tenure at the White House the executive branch has repeated variations of the claim that the border is not open, is secure, or that it’s the fault of Republicans that agencies lack the resources needed to address immigration.

Friday, U.S. Customs and Border Protection (CBP) once again shared a short animated video through their X account that touted the Department of Homeland Security as continuing to “enforce the laws of the United States.”

“If a noncitizen receives a final order of removal through their immigration court proceedings, they will be taken into custody, or remain in custody, and are subject to removal from the U.S.,” read a narrator as aliens were depicted boarding a plane. “These are our immigration laws, and it would take an act of Congress to change them.”

However, NewsNation correspondent Ali Bradley was quick to counter that claim and, within an hour of posting, had offered a brief explainer on how a “final order of removal” may not play out as it sounds.

Reposting the video from CBP, she wrote, “CBP sources tell me ICE (U.S. Immigration and Customs Enforcement) is currently monitoring the cases of 6.6M migrants–1.3M of them have received a final order of removal but that doesn’t necessarily mean they are taken into custody otherwise there would be 1.3M in custody right now–ICE only has the capability to actually track 300K people under the ‘Alternate to Detention’ program.”

“And if they do get picked up for removal,” Bradley elaborated, “they can file a motion to reopen which has an auto stay of removal and puts them back into proceedings to see a judge.”

Her blunt knockdown of social media spin that CBP is somehow handling the crisis came as House Speaker Mike Johnson (R-LA) had made a trek down to the southern border and addressed the failures of the administration.

A recently reported memo from the congressional leader read, “From the start of President Biden’s term, House Republicans have voted for significant year over year funding increases for Border Patrol and ICE beyond what his administration has requested. And from the start of President Biden’s term, his Administration has implemented policies that have undermined security and created a humanitarian crisis at the Southern border.”

“Now, in a desperate attempt to shift blame for a crisis their policies have induced, they have argued it’s a funding problem. Clearly,” said the speaker, “they have no facts to back up their claim.”

In fact, with a record-breaking 302,000 encounters at the U.S.-Mexico border in December alone, ICE wouldn’t even have the capability to track those illegal aliens, let alone the millions more that have entered America from around the world under Biden’s watch.

Bradley wasn’t alone in calling out CBP as others took to X to criticize what they called “treasonous nonsense” being spouted from the agency facilitating all but meaningless court dates years in the future.
