Court rules ’86-47′ Trump flag isn’t a threat despite assassination concerns

An Obama-appointed judge has issued a ruling on a controversial ’86 47′ flag being flown at a round-the-clock protest of President Donald Trump.

The National Park Service (NPS) has been told they cannot bar the Accountability NOW USA group from flying an ’86 47′ flag at their 24-7 demonstration that demands Trump’s impeachment, says Judge Randolph D. Moss with the U.S. District Court for the District of Columbia.

According to his 21-page ruling, NPS confronted the group in the past over signs that read “TRUMP RAPED LITTLE GIRLS” and “KIDS, IF YOUR PARENTS ARE MAGA, THEY LOVE CHILD RAPISTS.” In April, the group paired up with the American Civil Liberties Union (ACLU) to file a lawsuit against the Trump administration, claiming their First Amendment rights were being infringed upon.

In the ruling, the judge claims that there is no reason to doubt that political violence is “on the rise,” but insists that the flag itself does not display any call to violence and that interpreting the numbers as a “call to violence” was not reasonable in this case. Because of this, NPS was restrained from revoking the protest permit of the group that allows them to continue their demonstration.

“The government seeks to squelch core political speech without any articulable — much less evidentiary — basis for concluding that the speech actually threatens the life or safety of the President,” Moss wrote. “On the current record, Defendants have offered no basis to doubt that Plaintiff is engaged in fully protected First Amendment activity.”
