DOJ ordered to drop charges against NYC Mayor Adams … with a condition

Reactions to a Justice Department decision concerning New York City Mayor Eric Adams’ (D) Biden-era charges skewed partisan, including from one “infamous Zoom enthusiast.”

As the 2024 presidential election neared its end, then-former President Donald Trump made clear at the Alfred E. Smith Memorial Foundation Dinner that he believed the prosecution of Adams was akin to the lawfare that was carried out against him during then-President Joe Biden’s administration.

Monday, Acting Deputy Attorney General Emil Bove issued a memo to the U.S. Attorney’s Office for the Southern District of New York that held up that opinion as the charges against Hizzoner were directed to be dismissed without prejudice.

“You are directed, as authorized by the Attorney General, to dismiss the pending charges in United States v. Adams…as soon as practicable,” under the conditions that Adams agree to the dismissal without prejudice, leaving way for the charges to be re-filled in the future, and the mayor must agree that the decision did not make him the “prevailing party.”

“It cannot be ignored that Mayor Adams criticized the prior Administration’s immigration policies before the charges were filed, and the former US Attorney’s public actions created appearances of impropriety…” the memo noted in part, raising Adams voiced concerns with Biden’s open border policies.

Bove’s memo further asserted the charges “improperly interfered with Mayor Adams’ campaign in the 2025 mayoral election” and “unduly restricted Mayor Adams’ ability to devote full attention and resources to the illegal immigration and violent crime that escalated under the policies of the prior Administration.”

Adams was indicted in Sept. 2024, leading him to plead not guilty to one count of conspiracy to commit wire fraud, federal program bribery, and to receiving a contribution by foreign nationals, one count of wire fraud, one count of bribery, and two counts of solicitation of a contribution by a foreign national.

The allegations claimed he had accepted free or upgraded accommodations from at least one Turkish government official along with wealthy foreign businesspeople when traveling in exchange for things such as aiding in accelerating the opening of the Turkish consular building in Manhattan.

“We were just notified of the possibility that the DOJ has communicated with the local US Attorney’s Office here,” said Adams in a video shared by Fox News national correspondent CB Cotton. “I would like to speak to [my lawyer] first and get a better understanding of exactly what’s taking place now because right now I don’t have any information.”

While the memo ordered steps to restore security clearances and  “no further targeting of Mayor Adams or additional investigative steps,” before a review by the confirmed U.S. Attorney in the Southern District of New York after the Nov. 2025 mayoral election, Adams himself wanted to speak with his legal team. Former federal prosecutor Jeffery Toobin had no trouble asserting that he fully grasped the situation on CNN’s “AC 360.”

“This is one of the most bizarre situations I have ever seen… [Bove] makes complaints that [Adams] was politically targeted,” he told host Anderson Cooper who noted, “He says because he complained about immigration under the Biden administration.”

“Which there is absolutely no evidence of. And the Justice Department, now under the new Trump administration, dismisses the case against him, but says, well, we don’t know whether he’s guilty or not, but we want him to fight crime,” Toobin went on, bringing the matter around to the preferred leftist narrative of a power-mad Trump. “I mean, this is what happens in authoritarian countries.”

“The rule of law is not applied equally. It’s only applied to how the leader wants it applied. And Eric Adams has ingratiated himself with the Trump administration. And now he gets his case dismissed…And that’s not how the legal system is supposed to work,” added the former prosecutor.

While some echoed his sentiments, others agreed with the idea that the case “was complete and total garbage” from the start when considering the alleged behavior of the Biden administration, and it was right to provide time for the voters to weigh in before potentially reexamining the charges.
