DOJ reportedly shelves Biden autopen probe after failing to find criminal statute

One of the greatest scandals in U.S. political history is who was really running the show during the four years that Joe Biden was in office, and it could be that those questions will never be answered.

In news that will be a major disappointment if true, media outlets are reporting that the Justice Department has quietly “shelved” the investigation into the use of the disgraced ex-president’s autopen, which was used to sign off on controversial executive orders and pardons.

According to a New York Times report, the DOJ “scrutinized whether Mr. Biden and his aides broke the law in using the autopen to sign presidential documents, but was ultimately unable to move forward with making a case.”

Among the documents signed by “Biden” were the preemptive pardons of several prominent malefactors, including the J6 Select Committee and Dr. Anthony S. Fauci on his way out the door.

The probe was opened by former Trump administration pardon attorney and “weaponization” chief Ed Martin when he was serving as the interim U.S. attorney for the District of Columbia, but wound down under the tenure of current U.S. Attorney Jeanine Pirro, the former Fox News host and staunch ally of President Donald J. Trump.

NBC News reported that the case was never even presented to a grand jury. “It is difficult to bring a criminal case when there is not even a readily identifiable and applicable criminal statute, the person briefed on the matter said.”

Pirro’s office suffered a major setback last month when a grand jury refused to hand down an indictment against the “Seditious Six” group of Democratic lawmakers who urged military members to disobey “illegal” orders from Trump and Secretary of War Pete Hegseth in a social media video.

In June 2025, Trump issued a memo directing Attorney General Pam Bondi and the White House counsel to investigate “whether certain individuals conspired to deceive the public about Biden’s mental state and unconstitutionally exercise the authorities and responsibilities of the President.”

The New York Times report cites the now-standard anonymous sources in “three people briefed on the matter.”

Last November, Trump nullified any orders signed by Biden’s autopen.

“Any document signed by Sleepy Joe Biden with the Autopen, which was approximately 92% of them, is hereby terminated, and of no further force or effect,” the president said in a post to Truth Social. “The Autopen is not allowed to be used if approval is not specifically given by the President of the United States.”

“The Radical Left Lunatics circling Biden around the beautiful Resolute Desk in the Oval Office took the Presidency away from him. I am hereby cancelling all Executive Orders, and anything else that was not directly signed by Crooked Joe Biden, because the people who operated the Autopen did so illegally. Joe Biden was not involved in the Autopen process and, if he says he was, he will be brought up on charges of perjury,” Trump said at the time.

The senile former leader has insisted that none of the controversial actions were undertaken without his knowledge or that he was cognitively impaired at the time.

In an interview with the New York Times last year, Biden slammed Trump and other Republicans as “liars” and insisted that “I made every decision,” saying that he had staffers use the autopen of his signature on mass warrants for clemency because “we’re talking about a whole lot of people.”

“I made the decisions about the pardons, executive orders, legislation, and proclamations,” Biden said in a June 2025 statement. “Any suggestion that I didn’t is ridiculous and false.”

“The allegations from the @NYT that @DOJ @USAO_DC that were unable to move forward with a criminal prosecution into illegal autopen usage are disappointing. We will wait for the facts to emerge, but accountability for the ‘scandal of the century’ is desperately needed and deserved. We’ve laid out several ways to make that happen and will continue to push for results,” the Heritage Foundation’s Oversight Project said in a post to X.
