Judge allows wrongful death lawsuit against ‘deliberately cagey’ Rittenhouse to proceed

A wrongful death lawsuit against Kyle Rittenhouse was given a green light this week by a federal judge in Wisconsin.

John Huber, the father of Anthony Huber, one of two men shot and killed by Rittenhouse during the Kenosha riots, filed the lawsuit in 2021. He is “accusing officers of allowing for a dangerous situation that violated his son’s constitutional rights and resulted in his death,” PBS reported, adding that the father also alleged that Rittenhouse “conspired with law enforcement to cause harm to protestors.”

The elder Huber is seeking unspecified damages from city officials, officers and Rittenhouse.

U.S. District Judge Lynn Adelman dismissed motions filed by Rittenhouse and the government defendants seeking to dismiss the civil rights lawsuit, with the judge saying Anthony Huber’s death “could plausibly be regarded as having been proximately caused by the actions of the governmental defendants.”

Apparently, Rittenhouse didn’t make it easy on the plaintiffs, with PBS reporting that attorneys and private investigators for Huber “spent over 100 hours trying to locate Rittenhouse, tracking down addresses in seven states, before they found the home of his mother and sister in Florida. The lawsuit was served on Rittenhouse’s sister, who said that he wasn’t home.”

In the eyes of Judge Adelman, that was good enough to qualify as being served.

“Rittenhouse has been deliberately cagey about his whereabouts,” Adelman wrote. “Although he denies living in Florida, he does not identify the place that he deems to be his residence.”

Attorney Shane Martin, who represents Rittenhouse, noted that the ruling doesn’t address the merits of the case.

“While we respect the judge’s decision, we do not believe there is any evidence of a conspiracy and we are confident, just as a Kenosha jury found, Kyle’s actions that evening were not wrongful and were undertaken in self defense,” Martin said, according to the Associated Press.

A GiveSendGo campaign was set up to help Rittenhouse’s defense efforts, with the page description claiming that Huber “is represented by a Chicago-based, incredibly well-capitalized, Democrat Party-aligned law firm specializing in police misconduct and civil rights cases.”

“This civil action is an attack against Kyle Rittenhouse for being acquitted of all charges arising from his justifiable use of deadly force to defend his own life,” the page stated. “Moreover, it’s also intended to degrade further the protections afforded to us under the Second Amendment of The United States Constitution and our God-given Right to Self Defense. Lastly, this lawsuit is a broadside against law enforcement and seeks to diminish the heroic and selfless sense of duty displayed by police across the country and their commitment to the rule of law.”

Found not guilty by a jury of his peers, Rittenhouse still faces extensive legal bills fighting off the civil lawsuit. Huber, who spent time in prison on two occasions, first for violating probation after strangling his brother and again for kicking his sister, was the individual seen on video chasing Rittenhouse and striking him with a skateboard once he caught up to him.

Attorney Anand Swaminathan, a member of legal team representing Huber’s parents, said Wednesday’s ruling puts the family “one step closer to justice for their son’s needless death.”

“The Kenosha officials that created a powder keg situation by their actions tried to claim that they cannot be held accountable for their unconstitutional conduct; that argument was soundly rejected today,” Swaminathan said in a statement.
