President Joe Biden is unlikely to face charges in a special counsel’s probe into purloined classified documents found at his Delaware home and a former office, instead getting off with what amounts to a slap on the wrist from his own Justice Department.
In news that should come as little surprise to anyone who has observed the partisan nature of the modern-era U.S. system of law and justice, special counsel Robert Hur will issue a report that is “sharply critical” of Biden but will stop short of any criminal charges.
The Wall Street Journal first reported the not-very-shocking development on Thursday, citing the “people familiar with the matter” whose names were not disclosed by the outlet, a report that drew predictable outrage from critics of a system that protects its own. The news was also reported by CNN.

According to the WSJ, “Hur is expected to release a lengthy report in the next couple of months, potentially before the end of this year,” after he conducted interviews with “roughly 100 of Biden’s aides, colleagues and family members” including Secretary of State Antony Blinken, National Security Adviser Jake Sullivan, former chief of staff Ron Klain and Joe and Hunter Biden.
The documents were discovered in Biden’s old office at a Washington, D.C. think tank and in his home garage where he stored his beloved classic muscle car, a vintage 1967 Corvette Stingray that was given to him by his car dealer father.

CNN legal analyst Elie Honig rejected the idea that the disparate treatment between the top Democrat and former President Donald J. Trump is proof of the two-tiered system during an appearance on Thursday’s edition of “The Lead With Jake Tapper.

“So I can already anticipate what we’re going to hear from other, well, specifically one other network, Elie Honig, that this is a double standard! That Donald Trump was charged, and there’s a federal case and indictments about his mishandling of classified documents. And Joe Biden is not going to be charged. Obviously, the cases are different. Elie Honig, explain what you think about that,” said Tapper, a rabid Trump hater and Democrat cheerleader.
“Well, Jake, first of all, important to keep in mind, Robert Hur is a conservative. He was a law clerk to Chief Justice William Rehnquist. He was nominated to be U.S. Attorney in Maryland in 2017 by Donald Trump. So he’s not some liberal or Joe Biden-leaning prosecutor,” Honig explained, suggesting that the special counsel is above criticism.
“Second of all, there are differences between these cases based on the indictment that we’ve seen of Trump in Mar-a-Lago and based on what we’ve seen from the public reporting, starting with knowledge and intent. We’ll see. But presumably, Robert Hur has found there is no evidence that Joe Biden had criminal knowledge and intent,” he continued.
“Donald Trump has acknowledged publicly he knew he had those documents and he’s alleged to have had criminal intent. Second of all, let’s remember, Donald Trump is charged with obstruction of justice now, and the evidence set forth in the indictment is really quite overwhelming,” Honig said, providing what could be used as a script for all media reporting on Hur’s probe.
“In contrast, Joe Biden’s team, they came forward with the documents. They were the ones who brought it to DOJ. So two very big, very crucial distinctions there,” the legal analyst said.
It’s hard to see how the result will bolster public confidence in a Justice Department that has lost all credibility in the eyes of millions of Americans.
