Election integrity and executive authority took another blow amid ongoing lawfare as an Obama-appointed judge issued a ruling on the U.S. Postal Service (USPS) and mail-in ballots.
While the Senate took yet another recess without passing the SAVE America Act, the cogs of the left’s judicial activism machine kept turning. Tuesday, this amounted to U.S. District Judge Indira Talwani’s latest ruling on an executive order from President Donald Trump, issuing a preliminary injunction barring the USPS from “refusing to transmit mail-in or absentee ballots.”
In her ruling, Talwani both stated, “The record is devoid of any declarations or other proffered evidence to suggest that mail-in voting resulted in voting by non-citizens,” and the executive order “makes no reference to any noncitizens actually registering to vote or voting in Federal elections” in challenging one of the primary concerns that led to the order.
Specifically, the judge’s injunction prevents the Postal Service from implementing Section 3 of Trump’s order “Ensuring Citizenship Verification and Integrity in Federal Elections” that outlines USPS rulemaking on mail-in and absentee ballots.
Following the signing ceremony of the order at the end of March, which also directed the Department of Homeland Security to provide the states with lists of confirmed U.S. citizens eligible to vote and the Department of Justice to investigate election officials who’ve issued federal ballots to those deemed ineligible to vote, the Democrat echo chamber sounded off, “See you in court.”
Tuesday’s ruling was only the latest action from Talwani on the executive order, as she previously barred its use pertaining to voter rolls and ballots for federal agencies and the Postal Service, leading to an emergency appeal to the Supreme Court by the Trump administration. That request remains pending.
Of course, the Supreme Court already issued a separate ruling on mail-in ballots before the term ended. In that controversial 5-4 decision, the court found federal law permits the continued counting of non-military mail-in ballots that arrive after Election Day.
Recognizing the increased potential for fraud, Justice Samuel Alito sounded off in his dissent, “For state legislatures trying to understand what the election-day statutes allow, the majority’s decision opens Pandora’s box.”
Reacting to the ruling, Eric Daugherty of Florida’s Voice contended, “THE JUDICIAL COUP MUST STOP! She just ruled in favor of fraud. Activist judges are doing the bidding of the Democrat Fraud machine. If the Senate had passed the SAVE America Act, we wouldn’t be here. This is why it must be passed at all costs ASAP!”

Meanwhile, League of Women Voters chief of activation and justice Marcia Johnson, as a member of the lead plaintiff group, said in part, “Millions of Americans, including seniors, military voters, voters with disabilities, rural voters, and citizens living overseas, rely on voting by mail to participate in our democracy … The League of Women Voters will continue fighting to ensure that every voter can cast a ballot and have that ballot counted.” [emphasis added]
The administration is expected to file an appeal.
