Bernalillo County District Attorney Sam Bregman, Albuquerque Mayor Tim Keller, and Police Chief Harold Medina have all told New Mexico Gov. Michelle Lujan Grisham to pound sand after she suspended the right to carry firearms in and around Albuquerque for 30 days.
The brazenly unconstitutional move has already resulted in a lawsuit against Lujan Grisham. That is compounded by law enforcement and political leaders telling her flat-out that they will not comply with stripping citizens of their Second Amendment rights.
Top prosecutor Sam Bregman, who was appointed by Grisham, wants nothing to do with the unconstitutional edict.
Lujan Grisham issued her order on Friday banning law-abiding citizens from carrying guns in Albuquerque and Bernalillo County for at least 30 days. The Democratic governor said she issued her emergency health order in response to recent shootings that included the death of an 11-year-old boy.

NM District Attorney Sam Bregman said that he, as with Albuquerque Mayor Tim Keller and Police Chief Harold Medina, would not enforce the ban:

Many see this as the Left dipping its toe into unconstitutional waters regarding the removal of Second Amendment rights. It appears to be a test of what they’d like to do and what Americans will stand for.
Bregman, Keller, and Medina are refusing to enforce the order according to the Associated Press.
“As an officer of the court, I cannot and will not enforce something that is clearly unconstitutional,” he declared.
“This office will continue to focus on criminals of any age that use guns in the commission of a crime,” Bregman added.
You can bet that the DNC chose her to float this boat to see if they could get away with the “bridge too far”.

The National Association for Gun Rights and Foster Haines, a member who lives in Albuquerque, immediately filed a lawsuit in US District Court against the governor’s edict calling for it to be immediately blocked.
The president of the National Association for Gun Rights, Dudley Brown, accused Lujan Grisham of shredding the Constitution.
“She needs to be held accountable for stripping the God-given rights of millions away with the stroke of a pen,” he asserted.
“My initial reaction was kind of fear, because people that have through the concealed carry courses and spent the time learning how to properly handle firearms, they’re not the problem,” Ryan Burt, CEO of Calibers, told KOB-TV.

“The individuals that are doing what they’re doing in our community, it’s horrific. Unbelievable. I don’t even know what to say, and it’s those individuals that I don’t believe are going to follow this order,” Burt contended.
He claims his business has been harmed by the order.
“We’ve received hundreds of phone calls, people canceling their classes, people just not willing to come down because they don’t understand what’s going on. Normally, we would be pretty full on a Saturday. And as you can see, we’re not very full today. So it’s having an impact,” Burt claimed.
Lujan Grisham told The New York Times in an interview that she was within her authority to ban guns.

“I have emergency powers. Gun violence is an epidemic. Therefore, it’s an emergency,” she declared.
“No constitutional right, in my view, including my oath, is intended to be absolute,” Lujan Grisham said at a press conference.
When the radical leftist governor was asked if she expected criminals to follow her edict, she responded, “Uh, no.”
Conservatives are furious over the unconstitutional ban. Some are mocking it for the governor feeling she is above the law and the Constitution.

Bernalillo County Sheriff John Allen described Lujan Grisham’s 30-day “public health order” as “unconstitutional” during a press conference this week.
“It’s unconstitutional, so there’s no way we can enforce that order,” he said in a Monday news conference according to Fox News. “This ban does nothing to curb gun violence.”
“We must always remember not only are we protecting the Second Amendment, but at the same time, we have a lot of violence within our community. Let me be clear, I hold my standards high, and I do not or never will hedge on what is right,” Allen vowed.
In response to Allen’s statement, the governor told him to “stop being squeamish” about enforcing the order.

“I don’t need a lecture on constitutionality from Sheriff Allen: what I need is action,” she said in a statement. “What we need is for leaders to stand up for the victims of violent crime. We need law enforcement, district attorneys, public officials, school leaders, and state agencies to use every single tool at their disposal to stop this violence. Period.”
“We’ve given you the tools, Sheriff Allen — now stop being squeamish about using them. I will not back down from doing what’s right and I will always put the safety of the people of New Mexico first,” Lujan Grisham stated, doubling down.
“My constituents have reached out to me in droves, emailing and texting me that this is insane, this is horrifying, this is unconstitutional,” Republican state Rep. John Block claimed, according to PBS.
Even the ACLU voiced objections to the governor’s response to gun violence, expressing fear that it could lead to overzealous policing and infringe on privacy.
When politicians overstep their authority in a time of crisis, that is how we lose our country.

“This kind of approach leads to the over-policing of our communities, racial profiling, and increased misery in the lives of already marginalized people,” Lalita Moskowitz, litigation manager for the ACLU of New Mexico, commented according to PBS. “The governor should be following evidence-based solutions such as meaningful diversion and violence intervention programs and addressing the root causes of violence.”
The top Republican in the New Mexico Senate, Greg Baca, denounced the order as an infringement on the gun rights of law-abiding citizens, and Dan Lewis, who serves on the nonpartisan Albuquerque City Council, bluntly called it unconstitutional.
The head of the lobbying arm of the National Rifle Association, Randy Kozuch, issued a statement on Sunday calling the order a “shocking” act of “administrative fiat” that undermined “the fundamental rights of law-abiding New Mexicans.”
The protests go on as this case will surely make its way to the Supreme Court.
