Jack Smith requests gag order on Trump after TREASON and execution comments

Claims of a “treasonous act” and threats of “DEATH!” marked another attempt to silence former President Donald Trump by prosecutors.

A Friday filing in the United States District Court for the District of Columbia once again took aim at the president’s public statements as “likely to prejudice the jury venire” in the January 6 case. After the defense had expressed their opposition, the new filing from Special Counsel Jack Smith’s team specifically referenced remarks made on the campaign trail that included Trump’s take on newly retired Joint Chiefs of Staff Gen. Mark Milley as cause for a gag order.

“On September 22, on Truth Social the defendant falsely claimed that the retiring Chairman of the Joint Chiefs of Staff, a witness cited in the indictment, had committed treason and suggested that he be executed,” read the filing.

The Truth Social statement had read in full, “Mark Milley, who led perhaps the most embarrassing moment in American history with his grossly incompetent implementation of the withdrawal from Afghanistan, costing many lives, leaving behind hundreds of the finest military equipment ever made, will be leaving the military next week. This will be a time for all citizens of the USA to celebrate! This guy turned out to be a Woke train wreck who, if the Fake News reporting is correct, was actually dealing with China to give them a heads up on the thinking of the President of the United States. This is an act so egregious that, in times gone by, the punishment would have been DEATH! A war between China and the United States could have been the result of this treasonous act. To be continued!!!”

As previously reported, Milley himself had decried comments by the president and added to the hyperbolic responses by assuring “appropriate measures” had been taken to “ensure my safety and the safety of my family.

The requested gag order attributed to Assistant Special Counsel Molly Gaston also made reference to a follow-up post from Trump that accused Georgia Secretary of State Brad Raffensperger of engaging in a coverup for not acting on concerns of election integrity in the 2020 presidential election. “On September 23, on Truth Social, the defendant re-posted with the caption ‘What a mess!'”

“If the Court entered the proposed order, it would in no way hinder the defendant’s ability to campaign and publicly maintain his innocence. All it would limit is the defendant’s use of his candidacy as a cover for making prejudicial public statements about this case–and there is no legitimate need for the defendant, in the course of his campaign, to attack known witnesses regarding the substance of their anticipated testimony or otherwise engage in materially prejudicial commentary in violation of the proposed order,” contended the prosecution in countering the defense’s case.

Meanwhile, on Friday Trump tacked onto his claims against the outgoing Joint Chiefs of Staff and wrote, “Slow moving and thinking Mark Milley should never have made those calls to China’s Military Leadership. Does this moron, together with WOKE FOOL Mark Yesper (Esper!), who said ‘yes’ to everything, have any idea how dangerous a situation he put our Country in? Look at his words — STUPID & VERY DANGEROUS!”
