Minneapolis prosecutors charge ICE agent with felony assault

Prosecutors in Minneapolis have charged an Immigration and Customs Enforcement (ICE) agent with a felony for an incident that took place during the Trump administration’s immigration enforcement push into the Twin Cities earlier this year.

During a Thursday press conference, Hennepin County District Attorney Mary Moriarty announced that the agent, Gregory Donnell Morgan Jr., had been charged with felony second-degree assault with a dangerous weapon for allegedly pointing his gun at the heads of two people in a vehicle on a state motorway during Operation Metro Surge in February.

“Today’s charges reflect an important milestone in our effort to seek accountability for the harms inflicted on our community during Operation Metro Surge,” Moriarty told reporters.

On Feb. 5, the two civilians were driving eastward on Highway 62 on the Interstate 35W interchange when the agent approached them from behind in an unmarked black Ford Expedition. According to the complaint, the officer’s vehicle was driving illegally on the road’s shoulder when the person in the other vehicle claimed they moved in front of Morgan to “cut him off.”

When the car then moved back into the regular lane, Morgan pulled up next to it and allegedly pointed the handgun at the occupants who, not knowing that he was with ICE, called 911.

“There were no markings on Defendant’s vehicle that would identify it as law enforcement and the vehicle was not displaying or using lights or sirens,” the complaint states. “Defendant continued to travel on the shoulder but rather than continue to drive past the victims, he pulled alongside their vehicle, rolled down his window, and pointed a black handgun directly at Victim 1 and Victim 2. Victim 1 had a clear view of Defendant’s appearance, saw that Defendant was wearing a black t-shirt, saw that the gun was pointed directly at their heads, saw that the gun was a Glock or Sig Sauer handgun with what appeared to be a red-dot sight, and noted that Defendant 2 yelled something indiscernible.”

“Driving while pointing a weapon out of your moving vehicle at the victims who are in another moving vehicle could have led to yet another disastrous incident in a community that has already suffered too many,” Moriarty said.

Last month, the Hennepin County Attorney’s Office rolled out an online portal to report potential crimes committed by federal officers during Operation Metro Surge.

“Federal agents can also try to rely on Supremacy Clause immunity, but I’ve said this repeatedly and I wanna be clear — there is no absolute immunity for federal agents. And we must fully be fully prepared to litigate these issues before filing a charge in state court,” Moriarty previously said. “Make no mistake, we are not afraid of the legal fight, and we are committed to doing this correctly.”

Morgan is the first agent to face federal charges for his role in the beefed-up federal immigration enforcement presence that at least partially resulted from the massive scamming of taxpayers by members of the local Somali community.

It was during the surge that two left-wing activists – militant lesbian Renee Good and male nurse Alex Pretti – were shot during confrontations with federal agents, setting off mass protests and a tense situation between Washington and local Democrat officials that fell short of George Floyd-style violence when the federal government blinked.

The first of its kind case will almost certainly inspire Democrat prosecutors in other cities, with elected officials and political candidates having vowed to prosecute federal immigration enforcement officers criminally, including California gubernatorial candidate Tom Steyer, who is running on putting ICE behind bars.
