U.S. Department of Health and Human Services Secretary Robert F. Kennedy Jr. accused the Biden administration of blocking Christian families from fostering children while testifying before Congress.
A 2024 rule finalized by the Biden administration reportedly discriminated against religious foster providers who oppose gender affirming care, which includes body mutilation. The Trump official said “the number of foster children has dropped from 425,000 to 325,000” as a result of the policy.
“President Trump and First Lady Trump’s vision for foster care is one family for every one child. Currently, there are two children for every available foster family because the Biden Administration was excluding an entire class of foster families due to their religious beliefs. This is unacceptable, and we are changing that,” he declared.

The Biden-era rule established 3 conditions for placements, according to the Catholic news service OSV News:
That policy that said in order to be considered a “Designated Placement” for an LGBTQ+ child, the placement (provider) must satisfy three conditions: commit to “establishing an environment that supports the child’s LGBTQ+ status or identity”; undergo training for “appropriate knowledge and skills to provide for the needs of the child related to the child’s self-identified sexual orientation, gender identity, and gender expression”; and commit to “facilitate the child’s access to age- or developmentally appropriate resources, services, and activities that support their health and well-being.”
However, the Biden administration policy was later blocked by a federal judge who found the policy violated what is known as the Major Questions Doctrine, a legal premise that holds that significant economic or political matters should be left to Congress, not courts.
