Immigrations and Customs Enforcement (ICE) just nabbed a man who they say submitted a “fraudulent” homosexuality asylum claim.
Selah Dine Habib is reportedly an immigrant from Mauritania in northwest Africa who fled the country for the United States, being released into America by former President Joe Biden’s administration in 2023. Immigration officials say that at the time he filled out his paperwork, Habib claimed that he was a “homosexual,” which is currently criminalized in his home country, according to Human Dignity Trust.
Since being allowed to stay in America, Habib went on to obtain employment as a correctional officer in Portland, Indiana, working at the Jay County Sheriff Department Jail. He was also married in 2025 to the daughter of the county sheriff, whose office later gave him the job. So not only is he working a taxpayer-funded job, he is married to a woman in direct contradiction of his asylum claim.
The Department of Homeland Security (DHS) has arrested Habib and provided some additional details.
“He entered the country illegally in March 2023 near Lukeville, Arizona, and was RELEASED into the country by the Biden administration, where he was reportedly hired as a corrections officer in Indiana. He will remain in ICE custody pending removal proceedings,” the department said. “His pending asylum application is believed to be fraudulent, as he applied based on homosexuality in 2023 but married a woman in 2025.”
Jay County Sheriff Larry Ray Newton told WIBC that the immigrant did indeed work for the office, claiming that he had passed E-Verify checks during the onboarding process.
“According to Sheriff Newton, local officials had no reason to suspect Habib’s legal status was compromised. He noted that Habib presented a driver’s license and a Social Security card upon hire, adding that the department relied on the Jay County Auditor’s office to process and vet the legal paperwork,” the outlet noted.
“I am able to confirm that Mr. Habib submitted an I-9 with documentation, and an E-Verify Check was completed at the time of employment,” the auditor’s office revealed exclusively to WIBC. “The report came back as employment authorized.”
“Departments are responsible for completing any reference checks, background checks, drug tests, etc., before submitting new employees to the office. The sheriff would be able to speak to the standard practices completed in his office,” they noted in their statement.
Habib is currently facing deportation and is being held in Brazil, Indiana, pending proceedings.
