Karoline Leavitt warns Comey: You better pump-the-brakes on your victory lap

White House Press Secretary Karoline Leavitt is promising that the Department of Justice will take swift action to appeal a recent judicial decision regarding the Comey case.

U.S. District Judge Cameron Currie dismissed the cases brought against New York Attorney General Letitia James and former FBI Director James Comey without prejudice on Monday. Currie agreed with Comey’s defense team that Lindsey Halligan’s appointment to U.S. Attorney for the Eastern District of Virginia was not valid and thus, she could not legally prosecute the case.

Leavitt joined Fox News after the news broke to reveal that the DOJ is going to pursue an appeal in the case, arguing that Halligan’s credentials and appointment are valid.

Comey fled to reporters after the dismissal to express his gratitude over the judge ending “a prosecution based on the level of incompetence,” saying that it is “a reflection of what the Department of Justice has become under Donald Trump, which is heartbreaking.”

The former FBI director, who was indicted on two counts of making false statements and obstruction, may be celebrating too early, however. A case being dismissed without prejudice means that the prosecution is welcome to bring the same case again to attempt a more favorable outcome, which Leavitt says is exactly what’s going to happen.

“Everybody knows that James Comey lied to Congress. It’s as clear as day. And the judge took an unprecedented action to throw these cases out to shield James Comey and Letitia James from accountability based on a technical ruling,” she told Martha MacCallum.

“And we believe the attorney in this case, Lindsay Halligan, is not only extremely qualified, but she was, in fact, legally appointed. And I know the Department of Justice will be appealing this in very short order,” she added.

As BizPac Review previously reported, the New York attorney general was indicted on counts of mortgage and bank fraud for allegedly misrepresenting how she would use a secondary residence in order to receive a more favorable loan agreement. Comey, on the other hand, was indicted for allegedly “making false statements to Congress and obstructing a congressional inquiry” from his 2018 Crossfire Hurricane investigation testimony.

Attorney General Pam Bondi also vowed an appear shortly after news of the dismissal broke.

“We’ll be taking all available legal action, including an immediate appeal, to hold Letitia James and James Comey accountable for their unlawful conduct,” she told reporters at a “Safe Task Force” event in Memphis.

“I’m not worried about someone who has been charged with a very serious crime,” she added. “His alleged actions were a betrayal of public trust.”
