California Rep. Eric Swalwell’s (D) response to a criminal referral raised the question of potential further charges: “… sounds like obstruction of justice …”
A growing list of referrals has demonstrated a trend with Democratic Party officials and alleged mortgage fraud. As Swalwell found himself included with the likes of New York Attorney General Letitia James and California Sen. Adam Schiff, the lawmaker was found threatening President Donald Trump and his administration with retaliatory subpoenas.
During an appearance on MSNBC, Swalwell, who’d brought up the allegations against James, Schiff and Federal Reserve Gov. Lisa Cook, promised action against the White House as he said, “When we are in the majority, we will have subpoena power and accountability will happen. Bill Pulte and any other lawless official who is carrying out these political prosecutions on behalf of Donald Trump, they should familiarize themselves with the Judiciary Committee room because they’re going to be spending a lot of time there answering questions and I sure hope everything they did was above board.”
The stance had prompted Article III Project founder Mike Davis to suggest on Fox News’ “The Ingraham Angle” that fraud allegations may only be part of his trouble.
“Well, I would say this first off with Eric Swalwell, that sounds like obstruction of justice when you are threatening to go after federal investigators for investigating you for federal crime. So maybe that’s another charge that the Justice Department should tack onto its investigation,” he said.

Davis went on to quote Swalwell, who had previously posted on X, “If you commit fraud in this country, you will be indicted and justice will be served.”
“If you committed mortgage fraud, you will be indicted and justice will be served,” added Davis.
As had been reported, the congressman had been referred to the Justice Department by Federal Housing Finance Agency (FHFA) Director Bill Pulte for alleged mortgage and tax fraud related to the purchase of a $1.2 million home in Washington, D.C., claiming it as his “principal residence” despite being a resident of the state of California.
Along with the MSNBC appearance, Swalwell, who’d previously been booted from the House Intelligence Committee over his reported relationship with a Chinese spy, had insisted that the referral was itself retaliatory over a lawsuit against Trump, stating, “… the only thing I am surprised about is that it took him this long to come after me.”
Just as he appeared to vow retaliation against the administration for his criminal referral, the congressman had previously appeared to threaten action for being removed from the Intel Committee, stating, “We will not be quiet. We’re not going away. I think [then-House Speaker Kevin McCarthy (R-CA) will] regret giving all three of us more time on hour hands,” referring to then-California Rep. Schiff and Minnesota Rep. Ilhan Omar (D) who herself had been bumped from the House Foreign Affairs Committee.
