An unelected lower court judge has once again commandeered national policy by moving to block the government from freezing federal childcare funds to a handful of blue states amid rampant systemic fraud in Minnesota.
In a Friday ruling, U.S. District Judge Arun Subramanian sided with five Democrat-run states by issuing a temporary restraining order preventing the Department of Health and Human Services (HHS) from cutting off $10 billion in grants to childcare welfare programs impacting California, Colorado, Illinois, Minnesota, and New York.
Subramanian, a Joe Biden appointee, granted the states’ request for the TSO “to protect the status quo” while arguments are made in court. He could later move to extend the 14-day block, which, at least for now, forces taxpayers to continue funding blue state daycare scams.

The administration’s move came amid rising outrage after a viral video from independent journalist Nick Shirley shone a light on several Somali-run daycares in Minneapolis that did not appear to have children in attendance despite receiving millions in taxpayer funding, with one location boasting a misspelled sign reading “Quality Learing Center.”
“Families who rely on childcare and family assistance programs deserve confidence that these resources are used lawfully and for their intended purpose,” HHS Deputy Secretary Jim O’Neill said in a Tuesday statement.
The move impacted three programs “overseen by HHS’s Administration for Children and Families (ACF) — Child Care and Development Fund, Temporary Assistance for Needy Families, and Social Services Block Grant,” the agency announced.
Letters were sent to the states’ governors notifying them of the restrictions pending further review.
They then turned to their friends on the bench, with Subramanian moving with lightning speed to keep the money flowing.
“This decision is a critical victory for families whose lives have been upended by this administration’s cruelty. From childcare to shelter services for survivors of domestic violence, these funds provide resources that hundreds of thousands of New Yorkers depend on,” said New York Attorney General Letitia James in a statement, hailing the left-wing activist’s ruling.
“This illegal funding freeze should have never happened, and I will keep fighting to uphold the law and protect funding that our communities need,” she added.
Yet another act of judicial sabotage drew a strong response from many, including Deputy Chief of Staff for Policy and Homeland Security Advisor Stephen Miller.
“Federal district court judge rules taxpayers must fund infinite refugee daycare scams,” he wrote in a Friday post to X. “This is not a legitimate system. This is not democracy.”

“If the American public is unable to influence the outcome, we do not live in a democracy. The House, Senate and Presidency are Republican and yet a single activist masquerading as a judge is able to force massive fraud to continue …,” the former DOGE boss wrote.
“To prevent fraud, we asked states to provide receipts before sending taxpayer money for child care. Five blue states sued and an activist Biden-appointed judge just ordered us to stop asking. What are they afraid of?” O’Neill said in a Friday post to X, reacting to the judicial obstructionism.
“We will comply with the court, but we will fight. We will appeal. We will keep asking questions,” he added. “We will stop the fraud.”
