‘Not so fast there Gavin’: Newsom’s premature victory lap cut short by appeals court

An activist judge appointed by Bill Clinton ordered President Donald J. Trump, the commander in chief of the United States, to return control of National Guard troops to Gov. Gavin Newsom on Thursday and the governor wasted no time taking a victory lap.

Newson, who reportedly has his sights set on a 2028 White House run, has made the pro-illegal immigrant, anti-ICE riots a contest between Trump and himself,  and he pinned the following tweet at the top of his X feed.

But the Democrat was a little too quick to get out of the gates, because the Ninth Circuit Court of Appeals granted a temporary administrative stay Thursday evening, which allows around 4,000 National Guard troops to remain deployed in Los Angeles.

“Whoops not so fast there Gavin … 9th Circuit entered a stay…,” Harmeet Dillon, the U.S. assistant attorney general for the civil rights division, posted on X in response to Newson essentially celebrating while speaking with his media allies.

“At this early stage of the proceedings, the Court must determine whether the President followed the congressionally mandated procedure for his actions,” Judge Charles B. Breyer said in his ruling. “He did not. His actions were illegal—both exceeding the scope of his statutory authority and violating the Tenth Amendment to the United States Constitution. He must therefore return control of the California National Guard to the Governor of the State of California forthwith.”

Ignoring the violent rioting that has gone on for days in Los Angeles, Newsom had this to say about the ruling: “I’m gratified by the order… Today was really about a test of democracy and today we passed the test – we the people passed the test. Clearly there’s no invasion. There’s no rebellion. It’s absurd. And so we’re gratified. Today is a big day for the Constitution.”

While Democrat voters may buy Newson’s act, social media users were a little more adept at seeing through the smoke screen.
